I am an American citizen and filed the I-130 and I-129 forms for my husband in Jordan. The I-130 was approved just yesterday, August 22, 2006! My application for the I-129 was received in Vermont on March 16, 2006. I received a letter requesting additional information re: any prior criminal convictions I may have had on June 28, 2006. I have 87 days to submit this information. I do infact have a conviction for violating a protective order from 2000. Which was falsely obtained as a means of control by my ex-husband. At the time of the offense I was living at our home with him. And in the police report it states that the officer witnessed that I had my belongings there. I was still found guilty and this is on my record. I am extremely nervous that this will have an affect on my application result. I would absolutely die inside if they deny my husband the right to live here in my country beside me! If there is anyone who may have some insight or advise on this issue please do not hesitate to post! Any insight would be greatly appreciated!!

Agree with snz1802, you need a "competent" Immigration Attorney for your case. The complications of this case have increased exponentially. Get an Attorney, and a good one!!

I have been very honest in obtaining all the information re: this conviction. I also contacted an attorney and was informed that I would not need legal councel unless the I-129 was infact denied. The police report has been received and the court documentation along with a personal letter from myself explaining my case was attatched. Shall I hire the laywer now, before the denial, or shall I wait? And if so...any recommendations on a great laywer in Massachusetts and/or their fees? I am willing to do whatever it takes to assure that my husband is beside me here in the U.S.

Here's the USCIS memo explaining a bit more about how they're expected to process IMBRA cases: http://www.uscis.gov/graphics/lawsregs/han...IMBRA072106.pdf

I'd agree with the other posters and seek advice from a lawyer, though.

I only offer advice - not even legal. Just the plain and simple kind.
