Pregnant Fiance-K1 Filed

I am hoping to get some advise on a few questions, as I was unable to find an answere after extensively searching these forums. I filed my K1 on Nov. 16th and received the NOA1 on Nov. 19th, we recently found out that my Fiance (the benneficiary) is pregnant, only about 5 weeks, this was not our intention, but we must now take this into account while navigating the K-1 process, and have the following questions:

1. The doctor told my fiance that she can't get all the immunizations needed during the medical exam since she is pregnant, is there any way to get the vaccinations waived while she is pregnant and still obtain the K-1 visa? or does she absolutely have to have these vaccinations to enter the US?

2. She'll most likely be pregnant during the interview at the consulate, will we need a DNA test to prove the baby is mine?

3. Is there any way to expedite the process if we show the baby's father is a US citizen? wouldn't the government want this child to be born in the US? also I ask because i'd rather her be under care in the US, not Mexico.

4. Do I need to notify USCIS that she's pregnant now? and if the baby is born in Mexico, do I have to restart this process and wait again, or will I need to just amend the application?

Any advise would be greatly appreciated.

They do not care that she is pregnant no you don't need to notify USCIS.

No you don't need a DNA test.

No you can't expedite for pregnancy. - thats what CRBA is for if the baby is born abroad you file a CRBA and the baby gets a US passport.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

2.if she give birth before she leave the country,yes,because you will have to report the childs birth to the consulate

1. Not a problem. The panel physician will waive the ones bad for the baby. You will however (depending how long till she gets into the US and whether she's still pregnant or has given birth) need to see a civil surgeon in the US to get them to give her the shots she needs (or she can get them at a health clinic but take proof of the shots to the CS) and then transcribe them into an I-693 for her.

3. No. They don't care because other people give birth to USC's all over the world. As stated, CRBA is around for that reason

4. No don't need to tell them. If she's given birth by the time she gets her visa, she will need to remain in Mexico until she does the CRBA paperwork and obtains the baby's US passport. It is illegal for a USC to travel to the US on a visitor (or other) visa.

1. She doesn't need immunizations for the interview or the visa. Only for the AOS. She can get them after she comes.

Ever since the CAUSE of preganancy was discovered some 1 million years ago, governments have relied on responsible adults to decide such things. An uncontrolled moment of passion on your part, does not create an emergency on their part.

4. If the baby is borm before she arrives you will have to do a CRBA for the baby and get the baby a US Passport. If the baby is NOT born before she arrives, it is not an issue at all. You do not need to notify anyone she is pregnant.

Birth control isn't 100% and it's unreasonable to assume couples who are careful would abstain from sex just because of a 1% chance. However, like I said, we don't know the circumstances so it's best just not to judge at all.

Birth control isn't 100% and it's unreasonable to assume couples who are careful would abstain from sex just because of a 1% chance. However, like I said, we don't know the circumstances so it's best just not to judge at all.

It is the truth, not a judgement. USCIS does not care. The circumstances are that they had sexual intercourse, that is the way it happens. If you do that (and who doesn't?) then she MAY get pregnant and you MAY not like the consequences or particulars of where she gives birth, the timing etc. Make your bed and sleep in it. Or have sex in it, whatever you want. Deal with it.

When did it become "harsh" to tell an adult to live with the decisions they make? :unsure:

I would just like to say congratulations! :) Since your vias is already in process she may be here in time to have the Baby in a US hospital! If I were you I would check into flying while pregnant & what the Doctors say about that...

Thank you all so much for the information, I appreciate you taking the time to answer. I definitely am aware of the consequences and responsibilities of our actions and am fully prepared to deal with them, I just was wondering about the possibility of the affecting our K1 status and appreciate the help form the VJ community and the truth may be harsh but it's the truth and needs to be said. Thank you all again.

Nope, no expedites, not for a normal, healthy pregnancy, at least. People get pregnant and give birth all the time. Even in Third World countries.

Once the child is born, file for CRBA.

People are a member of Visa Journey so that they can seek out help and maybe a little support.. we are not looking for condescending attitude! Yes, I am a firm believer that "if the shoe fits, then wear it" but FGS lighten up just a little for ONCE as if you haven't ever been in a pickle... and egospiers, GOOD LUCK in your Journey and for what its worth... enjoy that Baby when he/she arrives in this cruel world!
