Never said she was. The OP did say for us to put on a consul hat and gave little info for us to judge their chances. If I thought they wanted only rosy answers then I would have not said what I did. As it is though and I have seen from another consulate that CO's look at attempts to enter the U.S. and failings as one of many things to take into account. They also take into account incomes and jobs and many other things. The OP asked for an opinion and I gave it. The OP will for sure receive mostly positive things and of course the OP will now feel good and be happy and discount the negative. I am sure that the OP and his babe will have no probs and live happily ever after.whistling.gif

She has tried and failed to come to the U.S. and failed by passing that test and failing it. She then finds another avenue for entry. She now finds someone that has little income and every reason to want someone to come and that person is a lot older and invalid.

Interesting answer Consul. I appreciate your response. I hope you will reconsider the Visa based on he following. I am basically debt free. I have no mortgage or car payment. When you have no debt it`s quite easy to live on 20k per year. 30k total household income. I`ve been able to save about $600 per month of that 20k. So please reconsider my ability to support my fiance.

As you can see I`m not the desperate humpback pathetic "invalid" sloth that you are portraying me to be. I have a Bachelors degree and consider my self intelligent. I`m just 46 and as you can tell you are not able to tell my disability from looking at me or speaking with me. I`ve had a number of relationships. It took me 10 years to find the one who shared my values on life and family. I was married once before and told myself I would be much more careful the 2nd time around. Having been around Filipinos for the past 20 years I know all the signals of a scammer or greencard seeker. It just becomes a 6th sense after a while. My fiance has never shown me any of these signals. In addition she has never asked me for a dime.

Consul I`m actually stunned that you have taken these giant leaps in determining our case. You see my fiance comes from a quite wealthy family in the Philippines. In fact her living with me will be a step down from what she is accustomed. Furthermore she really doesn`t need my assistance coming to the USA. She has had job offers in the USA that she has declined. However we have to go through the K-1 process just like anyone else.

You also made a reference to her failing a test. Let me ask you a question Consul. Have you ever not passed an exam in your life ? Should you be labeled as a deceptive scammer because of this ? You must also be aware of the complexity of a PT exam that takes 5 hours to complete.

I conclusion consul based on our conversation I hope you will reconsider issuing us the visa. Regardless of the decision you make today you have no business calling yourself Consul. Good Day

Not likely. Still trying to figure my babe out. She is real good but I know she will slip up one day. I will say that the Catholic wedding we had recently has me even more puzzled as that usually means since she is Catholic that now she plans on us being together for life. Sneaky.blink.gif

The companies who offered her a job were going to assist her in getting a H1B Visa. It`s basically the same way Filipino nurses are brought to the states. There is a demand for skilled medical workers who have similar education and training to US medical workers.

Most nursing positions are not H1 eligible, including from what you have stated, this case.

An Employer does not assist, the Employer sponsors a H1, pays the costs etc, not a cheap process. And until recently grossly oversubscribed.

Yes, I could be wrong about the type of VISA. But it is the same type of process the nurses go through. To be honest I don`t know much detail about those types of visas.

The only visa it could be is a H1, and that would require the applicant to have an appropriate degree AND the job to require it.

Buddy i read through this heres my suggestion find u a co sponsor now and i suggest the member be a close family member like mother father brother or sister then if it fails go to the phil and live u do draw SSDI so yes u can live there and still get that cause its money u worked for and paid in....

I myself just filed a K1 Fiancee Visa i draw SSI and when embassy interview time comes ill use my Mother as CO Sponsor some in Manila accept it some dnt but i do have a friend thats married to a filipina that draws SSDI and used his mom as a co sponsor and his wife is here been here for 3 months now Godbless and good luck to u

I like your chances for a visa. You have the income to qualify. And by the time you stop receiving your daughter's payment, your wife will have been working as a PT for years and contributing to your household income.

To consular officers, it's not only about income, it's about expenses too. You should show the consular officer that you have low expenses because you have no mortgage payment, and back it up with bank statements which show you save $600 per month. Your fiancée is highly unlikely to become a public charge under those circumstances.

If I were in your shoes, I would do two additional things to increase your chances. First, I would attempt to submit an I-134 or, better yet, an I-864. Second, I would attend your fiancée's interview.

I am on my phone so excuse me if I am offbase here. The home equity is of value towards the 125%. He owns the home outright which provides him security for a loan in tough times as needed. That is why they ask about home, property and life insurance. The fact that he is disabled is irrelivant. Equity is equity.

The child is a minor. He as the legal gaurdian of her recieves the money on her behalf for support of her So this is income. A savings bond issued to her can be cashed, no questions ask since she is a minor regardless of who purchased it for her. I see know difference.

Shouldnt he be looking at 125% for the support of two not 3?. I dont have a pc to look at the 134 rules.

I can assure you that neither YOU or anyone is qualified to make such a sweeping statement, as the qualifications of "ALL" are not known to you or them.

As for the daughter's income, I would equate it to court ordered child support which definitely IS counted as regular income to the parent receiving it. Like child support, it will end, but years after the intending immigrant is work authorized. If there's a denial in this case, it's unlikely to be as a result of finances.

His household size includes himself, daughter and intending immigrant. See earlier quote from the I-864 instructions regarding assets available for liquidation within a year "without undue harm to the sponsor of their family members".

Facts are cheap...knowing how to use them is precious...

I am referring to a cosponsor in the statement above.

A K-1 petitioner friend of mine recently used his brother as a cosponsor at the U.S. Embassy Manila, since my friend's income fell shy of the requirement. My friend's fiancée was successful in submitting the cosponsor's I-864, and received her fiancée visa.
