I was told by an attorney-consult only that I should not go onto disability-as it will look bad because the purpose of the support affidavit is to show your fiance will not become a "warden of the state" meaning use money from disability, medicaid etc. It does not matter how much your fiance has as far as money goes, or what she does-none of that is taken into account for financial matters-it is only yours. I am not sure of your specific country-but if it was in Africa you would not be granted a visa. I strongly suggest you get a joint-sponsor-if only for purposes of getting your fiance here. In the section where it says how they would contribute-I had mine state, "If X and her fiance fall below the poverty line, to ensure they do not need government assistance beyond what X has, I will support them financially to make sure they stay above the line of government assistance eligibility" This way your co-sponsor really knows the situation, and the US Gov't is confident your fiance will not become a warden of the state.

Typically, Manila would not allow a cosponsor in a case like this. However, Consulates CAN consider anything they want including the beneficiary's employability. In this case, I think the petitioner will qualify by adding the two disability checks together for he and his 13 year old child. It's their best shot regardless.

I would just list your daughter's $900 as your income. She is renting a room from you so it's rental income.

Or can she be a co sponsor. Is there an age requirement?

Daughter is currently 12 years old. No room rental. She does not meet the age requirement for being a sponsor.

Ok, I`d like to present my case and tell me if you think the Embassy in Manila consulate will grant my Fiance a K-1 Visa

Let`s just assume that the proof of meeting/relationship has been proved via boarding passes, pictures, Yahoo messenger and Skype records, other documentation,ect

So based on the above info do you think the Visa would be approved ? Yes, I realize each interviewer is different but in general do you think we have a good chance despite the affidavit of support issue ?? Maybe I left out some key info? If I did please let me know. Many of you have very good knowledge of how this process works. I`m interested to hear what your opinion is. Thanks so much !!

I don't think anyone can guess what the consular will come up with in his/her decision. I think the stronger the relationship proof the better your chances. On the financial, I would list the home equity as an asset. Again no one knows what the consular will decide on this issue but if you are bound and determined to try this without a sponsor it cannot be considered unless its listed. I would attach an additional statement to the financial document laying out your argument here, that you are close, do not wish to burden anyone with a sponsor requirement unless absolutely necessary, but saying your home is paid off is RARE. Most people have a mortgage or rent payments, so your minimal difference in income could be accessed in a home equity loan although it is not likely you will need to do this to support your fiance/wife because she is employable and your income is a sure thing which is also RARE. There is no risk you will be laid off or lose your income since its SSDI.

She has tried and failed to come to the U.S. and failed by passing that test and failing it. She then finds another avenue for entry. She now finds someone that has little income and every reason to want someone to come and that person is a lot older and invalid.

yes, I think no one is qualified to say what a consul will say in this case. If you factor in the economic situation and the disablility and the daughter, i would probaly give you less than a 50% chance. the daughters income will end one day its not sustainable.

just hope for the best. but prepare for worst

Guam is part of the U.S. and if she had passed the test she could have practiced anywhere in the States and the job offers would have come rolling in, you moron.

Not really, txn. She would still have to be licensed and credentialed in any state she was offered a job. Not so easy. I know people who are licensed physicians in China but can only practice to the level of Physician's Assistant in the US.

Not to mention the fact you make a lot of summations about the OP's relationship without seeing all the facts.

There is a reason many go to Guam and take all these licensing tests. It happens all the time. Guam is still part of the U.S. and the tests there are pretty easy to transfer to any state for licensing. It is cheaper to fly to Guam. Many do this hoping to pass the test and once they have the test results they then apply for a job and get a job visa sponsor. It is a golden ticket.
