How to Write Affidavit of the physical presence for 245(I)

what do you mean by letter? are you trying to establish proof of physical presence before Dec 21st, 2000?

because I've never heard of it.

yes, my lawyer required 3 different people saying that i was here on 12/21/2000.

There is no standard format for the affidavit. It needs to say that the person signing the affidavit knows you, and knows that you were present in the US on or before December 21, 2000. It should contain an affirmation statement, similar to:

"I swear and affirm that the foregoing is true and correct, to the best of my knowledge."

It must contain their signature and date, and their signature should be notarized or signed in front of a legal witness.

I'm really surprised that your attorney is not helping you with these affidavits, and I'm further surprised that he's even suggesting that you obtain them. They are, by far, the least reliable evidence that USCIS will consider as proof of your presence on December 21, 2000. They won't accept these as proof without an interview or additional evidence to validate the affidavit. Are the people who will be signing these affidavits willing to be interviewed by USCIS?
