K-2 Minor Child

Hello!

This is my first post but I have already used VJ for a few months now and it has been SO helpful with information.

My fiance and I will be applying for a k-1 visa (I am a USC) and hopefully bringing his daughter on a k-2 visa. I know that she can just be "added on" at this point in the process and it isn't until AOS that she will need to be separate.

So for now:

1. Does she need her own G-325a form? (She is only 2 years old)

2. Will she need to be present at the medical visit/interview at the embassy? Or just proof of certain vaccinations?

3. What do I need from her mother giving consent for all this? Is just a typed and signed letter enough?

12/27/12 - Married in Bamako, Mali

11/12/13 - I-130 package sent

11/15/13 - NOA1

05/27/14 - NOA2

06/16/14 - Case received NVC

07/01/14 - Case number assigned

07/21/14 - DS-261 completed

07/25/14 - AOS bill paid

07/30/2014 - AOS package sent

08/18/2014 - add-on AOS package sent (learned that I should have sent 2 separate I-864s even though the cases are joined...oops!)

09/19/2014 - IV bill paid

09/26/2014 - AOS checklist received

11/09/2014 - DS 260 completed online

12/22/2014 - AOS checklist package and IV documents scan date

03/02/2015 - Case Complete!!! (70 days)

04/02/2015 - Interview in Dakar (221g - Needed to verify a court document)

04/21/2015- Visas in hand!!

Me and my fiancee is in the same situation as you and cuz each country has differant rules I can only speak for the Phillipines were my fiancee is from.

1. The child does not need a separate G-352a but you must list her on that form as well as the I-129f from what I recall.

2. The child will need to get a medical exam and maybe required to attend the interview as well but wont need to answer any question cuz of her age.

3. This answer depends on which country the child is from and what the Emabassy requires.

Just so your aware I just also found in my case out that the child maybe able to accompany the mother at the same time the visa is approved so as not to be separated from the mother for a extended amount of time..I became aware of this 9 months into our visa process so perhaps its to late for us but something you may want to check into.

We are doiing the same thing thru Mexico. Here is what we did...the children were included on the moms original petition. we did include passport sized photos of the children in the original petition (tho it does not say you NEED to do this) Be sure to plan to be able to support yourself & 2 others later when you have to meet the financial requirement. We also front loaded the petition with lots of kid/family pictures so it is obvious that we are a family unit.

Later, once the petition is approved (NOA2) you will then have to fill out separate G-325a forms (I think...I am not positive on this but I assume we will be informed once the NOA2 comes with further instructions)

In the meantime we are seeking a notarized paper from biological Dad (we are fortunate that he is more than willing to do this)...giving mom permission to take kids to USA to live. I think this may vary from country to country, but Mexico will require at least this to bring the children here permanently.

In our case kids will go with mom to consulate & all cross into the USA at the same time.

You should be keeping records of the childs immunizations etc.

At this stage, simply list the child's name on the petition in the applicable section. Later, the child will apply for a visa, just like their parent will.

For the interview AND the AOS the child will have exactly the same application requirements as the K-1 in terms of forms, fees, medical exams, etc.
