They will probably just RFE you for all the missing proofs and forms. Just be sure to read the guides more carefully and get it all together, ready for that RFE. You cannot send anything without an RFE as it will not be joined to your original submission.

How do you know if your file has been touched or forwarded , etc etc.. I sent my K1 petition forms in 11/20/2010 and i still havent got word back, no check cashed.no touched. NOTHING WHATSOEVER!!..I checked the deliv. confirmation and it has been received...so im a little concerned as ive checked more then a dozen members status and 9/10 they have been received and touched on the same day or the next!..wondering why MINe is taking so long! ;-(

I could just be having an off day honestly... give me a sec and i'll get back to you.

**Edit - yep. I did a search for "RFE" in K1 and Embassy places and while I got some hits, it's usually for discussions about the AOS stage.

I know people get requests for more evidence at the interview but that's the visa process and isn't really an "RFE".. i mean obviously it fits the term but an RFE is typically something mailed to you. I think they call it a blue slip or something if you get an RFE at the interview (I don't think Aus do colours..)

Maybe someone else will chime in and tell me I'm an idiot (totally possible and lets hope so) but most RFE's I see are for adjustment of status and stuff like that... within the US.

So no one gets an RFE between their NOA1 and NOA2? I'm still confused. I already got the NOA1 with my Receipt Number.

You sent it in on a Saturday. And the next week was a three day week because of Thanksgiving. Not sure anyone's even returned to the office from Thanksgiving yet! Patience. :)

Not that I've ever seen or noticed (or that I can remember seeing or noticing). Both myself and my fiance (now husband) didn't hear ANYTHING until we got NOA2. All the petition is is assessing the USC's eligibility, and the fiancee's eligibility. File comes to their desk.. they enter info, run some checks, send it to the FBI etc and NVC, then send you NOA2 and send the file off to your home country.

I wouldn't think they need to RFE... you're either eligible or your not... and if you haven't sent enough info for them to CHECK if you're eligible then they'll just reject you. Like I said, I've heard of RFE's at the visa (interview) stage, but not petition.

Well here's to hoping they can check! :) I'm curious what they'd need to check if we're eligible. I'm still going to call them tomorrow and see if I can figure out a way to get these documents to them or something. Thanks!

This is what happened to us. Not knowing what to send in as we've never done this before, we sent the 129F with no supporting docs back in April, on June 24th we got a denial notice. We then did our research and realized what we did wrong. Sent a whole new packet (this time with more than enough documentation) on July 2nd. We are still waiting for our NOA2.

This whole process is a nightmare. The 5 month timeline is bad enough, but we had to deal with this twice and its still nowhere near complete. Also, the fees went down, not that it helped us as we paid the higher fee twice :(

My advice is to call and report a problem with the application, explain to them what happened and see if you can get it back. However, i think you might be out of luck with the money. Since they already cashed the check I dont think they will refund you.

I just called them and got the typical scripts. "If we need more information from you...." and "Some reasons for a rejection would be an incorrect fee, no fee, or no signatures." So it was kind of encouraging to hear that, but I don't count on all that info being correct. Should I call again and ask to speak with an Immigration officer?

It's been since September 14th.. if they were going to reject it, would they have done so by now?

May or may not help but ask to speak to a tier 2 rep. or the supervisor of the person you get on the phone.

Called again, asked for an Immigration Officer. She was much nicer, not scripted at all. She was saying that they'll just ask me for more info. I said that I was worried it would be outwardly rejected, and she said, "While I can't promise that, so far, it doesn't look like anything is wrong with your petition. Give it another month, and if you don't hear anything then, give us a call back." So she was suggesting that they'd probably just ask for more info as opposed to outright rejection.

Course, until it's done, I'm going to worry... I guess I'll keep you guys posted and check my texts, emails, and snail mail every single chance I get!

Definitely call and talk to someone higher than the phone answerers. If I were in your position and couldn't get through to anyone higher, I would send the package that you have, certified mail or overnight mail with a copy of the NOA1 on top to them. On the envelope remember to describe what is inside the envelope using the receipt number. I don't know if it would help you or not, but that is what I would do.

Also only send copies and make sure you still have a package that you can copy again if needed.

  • 1 month later...

As an update... still haven't heard anything. I was told to call them back if I didn't hear anything within a month. I did, but that was no help either. :( Still unsure if I'll get an RFE or just flat out denied.

I did the same thing you did and got a denial after two months of waiting and 500 bucks waisted.

You can call all you want but you will be told to wait for an RFE that wont come.

My suggestion:

File an expidite request for a semi valid reason. then send in your entire packet with the expidite request. that is the only time they take in information other than when they send you an RFE.

just be quick about it. cause they dont actually have to accept it when it comes in but at least it gives you a bit of hope.

When i did my expidite request i did it over the phone and it didnt work because they didnt allow me to send in info, the person said that they would ask for it later, which they didnt, they just denied it.

so if i had a second chance i would mail in my expidite request with all my backup.

might work, might not.

also, just be prepared to refile right away.

another option would be to drop your petition then refile right away.

Would sending an expedite request with the rest of the info even work? Would they attach it to my original petition?

No, the new material you'd send would never catch up with your petition. Be patient, wait for them to respond to you with what they need. It's a long wait for everyone, but don't risk making it longer by sending in information before they've officially requested it from you.

I don't think they are going to ask for it. That's the problem. Every other person who has posted who has made the same mistake has just waited months, and then got a denial without an RFE. :(

Unfortunately, that's something you'll have to deal with if it happens. Sending in information now will never catch up to your petition.
