hello SimplyMacy!, im so glad to hear your thoughts about our case, it really took away my anxiety, i will talk to my mom about that I-186 form and talk to our atty. about this matter, im disappointed that our atty didn't explain this situation to us before pushing through the application, :angry: i hope that the consul in the philippines would understand our situation and approve our case, :D by the way, i think our family really is inline with nursing including my mom, my brother although he's a CNA and my stepfather, my father, my stepmom, me and my fiance, :rofl:, thanks for sharing your toughts! it really helps! god bless! :thumbs:

Fire your attorney! :lol: Don't be disappointed with your attorney. He didnt know that USE Philippines doesn't accept a co-sponsor in most cases. The acceptance of co-sponsor really depends on the situation and USE regulations. Just let your mom write a sworn statement that she will be your co-sponsor in i-864 when you adjust your status after your marriage and let your attorney be the witness. Anyway, your fiancee will bring all these documents for interview in Philippines.

12/01/2010 - Received a letter from DOS dated 11/29/2010 stating that the petition will be forwared to USE AD within a week and that I will received the packets very soon from embassy.

01/18/2011 - Interview. APPROVED!!! No words can express how happy i am.

01/25/2011 - VISA in hand! YAY!!!

02/20/2011 - POE Chicago (O'hare)

05/14/2011 - Our Wedding day

hello! i am on k1 visa too and still waiting for our noa2.My fiance has a job but it does not meet the required income needed for a household of three.I was so worried that i will not be granted a visa during the interview in Manila because of this matter.But 2 of my friends who are now in US assured me that it is not a problem since i can get a cosponsor.My 1st friend's fiance was working in the phils so he did not file taxes in US, so he couldnt provide a tax return which is a requirement in form 134.So he asked his mom as cosponsor and the form she filled up was the one showed during the interview.And there wasnt a problem.She was granted a visa and as i said she is now in US.My 2nd friend was also petition thru k1 with a cosponsor.His fiance lost a job and so he asked his mom as co sponsor.

So i wonder where u read that post that says cosponsor is not allowed in Phil.Immigration..

From what I had learned for the K1 visa you have to do the 134 form by your self regardless what your income is and another 134form from your mom, friend or...Form 134 does not allow you to have a cosponsor (simply doesn't have space on the paper for it). I did 2 for myself and a letter from my mom stating that her and my father (because they do taxes together) are going to be my fiance's sponsors. Form 184 is different and it's later down the road.

I agree that the U.S. Embassy Manila sometimes accepts cosponsors.

I agree that the cosponsor should be a close relative.

I agree that fresh college graduates have a better chance of having their cosponsor accepted.

I believe that you should attempt to submit an I-864 and an I-134 from your cosponsor.

I believe you would have a better chance of approval if you attended your fiancée's interview.

I believe that all of these factors would potentially give you a chance for a visa.

I predict your biggest obstacle will be if you have no current sustained income.

I have not seen a K-1 approval at the U.S. Embassy Manila in a case where there was absolutely no income.

I don't have time to hunt down the post right now, but...

Over a year ago a VJ member wrote an email to the Embassy in Manila asking about co-sponsors for K1 visas. In their response the Embassy said that they usually don't accept co-sponsors for K visas. They expect the petitioner to qualify on their own. However, the will occasionally accept a co-sponsor on a case-by-case basis if the petitioner has a valid reason for having a low current income, and has good prospects for improved income in the near future. They specifically mentioned that a petitioner who was a student or recent graduate would be a good candidate for accepting a co-sponsor. They also said that they prefer a co-sponsor who is a close family relative because they would be more likely to follow through and sign an I-864 when it comes time for adjustment of status.

What this means, specifically, is that your chances of being approved with a co-sponsor go down if you've been working a low paying job for years, and don't have a reasonable chance of getting a better paying job soon. It also means your chances are lower if you're on long term disability or other fixed income. Your chances are also low if your co-sponsor is a friend or acquaintance rather than a relative.

This is specifically about the Embassy in Manila. Each consulate has it's own policies.

Petitioners in fiancé(e) (K1) nonimmigrant visa cases are generally expected to provide the adequacy of their own financial resources to ensure that an alien, after admission into the United States, will not become primarily dependent on the US Government for subsistence. While our immigration law does not disallow joint sponsorships for K nonimmigrant visa applicants, the mere submission of an I-134 Affidavit of Support from joint sponsors is not sufficient to establish that the alien is not likely to become a public charge. Accordingly, we make a thorough evaluation of other factors, such as the sponsor’s motives in submitting the Form I-134, the sponsor’s relationship to the applicant or petitioner, the length of time the sponsor and applicant have known each other, etc. An I-134 Affidavit of Support submitted by a casual friend or distant relative who has little or no personal knowledge of the applicant has limited value. Unlike the I-864 filed by joint sponsors in immigrant visa cases, the I-134 is not legally binding and imposes no legal obligation on the joint sponsor to make good on his or her promises. Please be assured that we look at the totality of circumstances in assessing the credibility of joint sponsorships.

Something that I do not think any other member has yet mentioned is that the OP is studying for his NCLEX, therefore presumably soon he will be able to get a job as a registered nurse and meet, on his own, the poverty guidelines.

OP, how soon will you become a registered nurse? Perhaps by the time your petition gets approved by USCIS you can get your job as an RN and show your recent pay in your affidavit, along with your mother's co-sponsoring (just in case).

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

OP, how soon will you become a registered nurse? Perhaps by the time your petition gets approved by USCIS you can get your job as an RN and show your recent pay in your affidavit, along with your mother's co-sponsoring (just in case).

It would be very helpful if Lorenzo got a job, any job, before his fiancée's interview. Even if he worked for only a couple of months at a job which put him on a trajectory to earn over 125% of the poverty line for his household size and the area he lives in, his fiancée would stand a much better chance of a visa approval. This is one way he could do it on his own, and would not have to rely solely on whether Manila would accept his cosponsor (and approve the visa too).

Even though the consular officer will take into account Lorenzo's education, employment potential, his fiancée's potential, and other factors, I fear that he will run into trouble because he simply has had no income whatsoever. I've not seen a case in Manila that's been approved under these same circumstances.

i have read on lots of sites and also some forums,i just don't remember, think repression is setting in lol, anyway im happy to hear your story and be re assured by your friends who have passed this, also knowing that im just not the only one going thru this situation, as for me im still waiting for the consulate to reply on our petition its been 3mos since we mailed the application but there is no single mail yet, :( i can't wait to be with my fiance i miss her already, 4 yrs of my life(college) we've been together this is the only time were been separated for tooo long! but were here and all we have to do is wait and pray ofcourse, thanks and godbless! :D

hi Aztec&Taino!, im on the last lap of my review and my target for taking the exam is coming late dec or early next year, i just feel more pressured to finish this damn test and get a job, but taking the nclex is not that easy i have to be 100% ready when i take the test besides its to expensive to register for the exam, also my mom said that i dont have to get a part time job i just need to focus on my exam, after this i would have to go to texas to visit my dad so i can't get a job real soon, maybe early next year, i just hope the consulate would consider if ever the interview comes...

you haven't yet received NOA1 from USCIS?

NOA1 does that mean the receipt no. or something? because that just the mail the i got..

hello Tahoma!, that's what i fear also that i will get into trouble if the consul. would know that i don't have any job experience,income whatsoever, im really trying to finish this nclex and go for a visit to my dad at least 1month then comeback maybe get a part time job while finding an opening, im pretty sure my mom will help me find a job since she is also a nurse, im just hoping that for now things would go well..

If you don't mind, I would like to ask some questions about your friends' visa approval:

1. How long ago was the visa issued?

2. How much income did the petitioner report on his I-134?

3. Did the petitioner submit bank statements with his I-134 which showed deposits from his income from the Philippines?

4. Did the petitioner use any liquid assets in place of income on his I-134?

5. Did the petitioner work in the U.S., for even a short time, right before the beneficiary's interview?

6. How old was the petitioner?

7. What does the petitioner do for a living?

1. How long ago was the visa issued?

2. How much income did the petitioner have up to the time of the beneficiary's interview that year?

3. Did the beneficiary use any liquid assets in place of income on his I-134?

4. How old is the petitioner?

5. What does the petitioner do for a living?

You probably mean that you are waiting to hear form the USCIS...not the U.S. Embassy Manila.
