As many know, my wife and I need to prove our relationship. Does anyone know if taking and passing a polygraph test would be solid evidence in the eyes if our interviwer? Ty in advance mike and alsu

I have never heard of USCIS using a polygraph for an AOS case - ever. The only time I've ever heard of anyone voluntarily submitting polygraph results to USCIS was cases involving petition denials under the Adam Walsh Act, and I don't know of any concrete evidence that it helped them.

From a practical viewpoint, I doubt they'd give it much credence unless they are overseeing the test and determining what questions will be asked.

At the interview, did they specifically ask you to return with more evidence? Or, did they tell you that they would contact you when they'd made a decision? If they didn't give you an RFE for more evidence then you should probably just wait and see what they decide to do. The ball is in their court now.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Agreed. I mean it couldn't HURT but then you'd need it to be official with a list of questions and the results from those. in a sealed envelope of course so you can't tamper with it.. and even then there's no guarantee.

What DID they say? What did they ask for after the interview? Did they ask you to wait and you'll hear back? Did they take her I-94? Did they ask you to bring more evidence (this is an RFE)?

They gave me a list with some boxes checked, others not checked. He checked the tax return box even thought I explained that we married in April and wouldn't filing taxes until after the new year. He checked a more photo s box even though we produced over 200photos, .We have until dec 21 to send it back

ok so now we all understand the uscis sent you a RFE for taxes and more pictures, but you said you sent 200 photos, tell us more what visa and interview are we talking about,

The OP's original topic is here: http://www.visajourney.com/forums/topic/284189-is-this-kind-of-harassment-common/ I have contacted a moderator querying whether the two should be merged.

If you would look at the forum, it is for AOS from non-K visa.

OP, so you got a RFE for more evidence. Carefully gather as much evidence as you can, and submit by the deadline. Then they decide something and get back to you. No need to add things that aren't listed on the RFE. You are going to have to do this all over again in 2 years, btw... you will have to remove conditions on your wife's GC because you have been married less than two years. Might as well settle in for the long haul. Good luck.

200 photos are a lot, but maybe it is the variety they were querying, ie maybe they think the photos are all from one or two vacations together?

Do you have any photos of the wedding, or you two with your respective families? Did the photos clearly show that they were from throughout your relationship?

Obviously a poligraph test is irrelevant here. You should submit only and only what USCIS required on that checklist, in your case more photos and a joint tax return. If a joint tax return is not available, you should write a letter of explanation for it. I remember we didn't have a joint tax return for the first year either for the same reason, but it has never been an issue for the AOS interview, as we had more other convincing pieces of evidence for our marriage. Every case is treated differently by USCIS.

A lot of people were confused since you started a new thread, which I guess is fine but then you need to restate the background information. So the people that didnt see the old one know what you're

talking about. I know your upset about your interview. but if you take a deep breath, you'll realize you can file your next tax return in about a month. then you'll have a tax return with her name on it.

In the mean time go get yourself a bluecross blue shield health insurance policy with both of you on it.

I would suggest you dont deduct the maui trip as a business expense even though you were probably playing poker while you were there.

Do yourself a favor and dont tell the guy you spent $7000 on the wedding trip like you should get some xtra points for that.. What that says to me is you've got a lot of money.

You come across here as someone who likes to live a flamboyant life style.

so the wedding trip is just an extension of your personality. If you fly across the country 7 times a year to play poker then you flying to maui is like me driving to the grocery store.

the cultural difference between you and the Imigration officer seems to be as big as the difference between the US and the Philippines. You are so happy being you, you dont have a clue where this guy

is coming from. If you want any sympathy from these guys you need to bridge that cultural gap. The facts of your case are not all that favorable so you need all the sympathy you can get.

I would strongly suggest a good lawyer, he will understand what the officers need to hear and he can coach you on how to act and what to do in general. Yeh lawyers are a scam like the health insurance

but you see what you have accomplished so far on your own. I think if you had hired a lawyer in the first place you would not have walked into that interview with pictures of a russian girl he had already denied.

At the moment you seem to have a losing hand. Its time to go all in (hire a lawyer).

You started this thread asking about a polygraph test. I think you already got your answer on that.

no one thing is going to make it right. Between the two threads you've recieved a lot of good advice.

but I think the best thing to do now is find a good imigration lawyer.

Dan
