Ok, so my husband and I are finalizing our forms for the AOS and I have an interesting question that I haven't seemed to find the answer to on here. My question pertains to the affidavit of support. On line 22 of form 1040 (fed income tax form) I have met the income requirements. My job however, also earns me tax free money that last year equalled to $5000. It was money that I earned, however, it was not included on line 22 of my tax return. It is in a separate box 12a. It would seem to me that including the extra $5000 into question number 23 on the I-864 would be beneficial to our case but can I do this? If so, is it simply a matter of adding the two numbers together?

Just thought I'd ask.

Oct. 1, 2010 - POE (very easy, no problems, and he even got approved to work!)

Oct. 20, 2010 - Married in Las Vegas baby!!!!

Dec. 3, 2010 - Sent AOS and EAD

Dec, 5, 2010 - I-485 and EAD received

Dec. 10, 2010 - Date of NOA 1

Dec. 11, 2010 - NOA 1 received in mail (they told us it would take week in the email =p)

Dec. 18, 2010 - Biometrics appointment notice received for January 12, 2010

Jan. 12, 2011 - Biometrics Appointment (Strange but fine)

Jan. 13, 2011 - Transfer to CSC NOA received (dated January 7, 2011)

Feb. 9, 2011 - Email notification of a Decision: AOS Approved!!!!

Feb. 11, 2011 - Email notification Green Card in mail

Feb. 17, 2011 - Green card received!!!! The card wasn't green =P

What is the nature of the extra income? Is it declared anywhere on your tax return? I ask because it may not be clear to them where the extra $5000 is coming from unless they can see it clearly on your supporting documents.

If you're confident that the source of the income will be evident to them, then yes - just add it to the number in section 23.

Line 23 doesn't have to match your tax return. It's what you are reporting as your current income. Maybe you've had a raise since last year, etc. Use your current salary. You can include alimony, stock dividend income, child support. You are not required to send documents to prove it, that's optional says the instructions. But anybody would be foolish not to back it up with evidence. If it's on your W-2 point that out to them on a photocopy of it. My line 23 was miles and miles different from the income tax reported on line 25.

Ok, thanks for the advice! I apologize for any confusion. Box 12a, where the extra $5000 is, if located on my W2 form. I have not found it anywhere on my 1040 income tax form. I did however get a small raise since last year and I suppose I can highlight that raise on my paycheck? I am not sure where else to show this raise except for a letter from my employer. Also, I make an hourly rate, my salary isn't really fixed. Does that matter? I guess I am getting a bit concerned. I understand that is desired amount is 125% of poverty for two people. While I have reached that number, I keep thinking adding more money to it will only help my case. Does it really matter? Could I have made $18,213.50 and still get approved??? Lol, just obsessing a bit I suppose. I hope all is well! Thanks
