Please help...Case sent back to USCIS from state deparment for review????

My husband has called the USCIS multiple times and ALWAYS got a different answer. We don't even bother anymore; going straight to the senator. It was getting to a point where USCIS was downright mocking TSC ( hey, I'm all for it :thumbs: ) for causing this huge delay and confusion. clearly the left hand does not know what the right one is doing.

I'm tired of it but thank God I'm the beneficiary, so I cannot call for after that phone call our petition would placed in the bottom of the pile...

damn right. . .i thought being transferred to TSC was a good thing. . .turns out it freakin sucks. . .im seeing September filers getting approved before us. . .this sucks. . .my 5th month mark would be next week i hope to hear from them by then. . .if not im'a bug them with calls. . . :devil: anyway, goodluck to all of us. . .this journey with the TSC really sucks

nope, i haven't heard from them. . .and my due is drawing near. . .i should be approved by Jan.17 at least that's what they told me last November when we called them. . . :blink: what about u? it's really depressing seeing September and even some October filers getting approved.. .it feels like hell. im crossing my fingers. . .1 more week if i don't hear from them i'll call them right away. . . :thumbs:

Hell Everyone - Same situation here. I sent my I-130 application to California's office last July and it took them one month to add to the system (NO1 on August). Then it was sent to Texas early November and three weeks later I got the same letter (sent back from Department of State for review!). It moved to Post-Decision without any decision I guess! Still waiting like everyone else here. My five months will be over at the end of this month, hopefully something positive will happen before then because I hate to call any office which I think is run by retards (ok not all of them but some of them are).

well, if they received on Aug 1st, then your 5 months is already passed. (8/1-9/1, 9/1-10/1, 10/1-11/1, 11/1-12/1, and 12/1-1/1), it's already 10 days passed the 5 month mark, your should start calling them by now.

August 25th was the actual date. So the 25th of this month will be the 5 moth mark. Thanks for your reply though.

I called USCIS on Friday to enquire about my petition and got the same answer as most of you: that I should wait for 180 days before starting an investigation... However, the agent I talked to seemed very surprised that I hadn't received a decision on my case. I asked if I should make a local Infopass appointment so I could discuss this situation with an immigration officer. She said "yes". So, that is what I'm going to do at the end of this month, when I'm theoretically outside of the 5-month processing timeframe. That is, of course, if I don't get anything from USCIS by then. I'll keep you posted. Take care, everyone!

I just called USCIS earlier today and talked to a 'first level' agent who transferred me to a 'second level' agent (that's what they refer to their level of access to information in the system). The second level having more access. Anyhow .. I was told basically the same thing that I should have received an approval letter since the last status says that the application was received back from the Department of State and all I can do now is to wait another 120 days! Then after I insisted that there has to be something wrong since I haven't received anything indicating approval and there is nothing in the system (accessible to both agents first and second level) that indicates that approval, the second level agent sent a request to Texas office (after my insistence to get more information) and informed me that I will receive more information (a letter) from Texas within 15 days. I think everyone of us (in the same situation) should start a flood of requests to the Texas Office (through USCIS) so that they fix whatever they had screwed up. It is really frustrating.

McManaman, Krisca, and everyone else in the same situation! I woke up this morning to find an email from USCIS stating that my I-130 has been approved and that I would be getting my approval notice within a few days!!! Hurray! All my worries are gone! :dance:

All of you, please hang in there! I am absolutely convinced that you will also be getting your approvals these days. There is a God up there who sees everything and who is working so that justice will be done to each and every one of you. My petition was approved just 17 days before the expiration of the 5-month processing period.
