Worth filing an expedition request?

I'm considering filing an expedition request with the NVC. Su and I (Matt) are both in Brazil. I've been here for about 18 months (it's too hard to be apart). I walked away from a career and a huge promotion to be with here - but I doubt that's considered a financial hardship as far as an expedition request. However, Su just got fired from her job, so neither of us is working at the moment, though she is looking for other jobs. I'm wondering if both of us being out of work might fulfill the 'financial hardship' qualifier for an expedition request. And - do we need to send documents to back up an expedition request, or will they actually consider it carefully just based on an e-mail? I asked an NVC rep about it over the phone and she was very wishy-washy ("You can do what you want, it might help.").

I'm getting depressed about the whole thing. I feel like our case is in the doldrums. One of Su's friends had her interview scheduled for early January. We'd figured or hoped we'd have a December interview - but looks like that won't happen. I have a flight back on January 26th because I figured 'another 3 months will do it'; looks like the process has kicked me in the teeth again. I have job offers in the Austin area and I have people just waiting for me to arrive to get me into a position. Ugh...anyway.

If you have been in Brazil for 18 months, why didn't you just do DCF? When did you file?

I would suggest going back and taking the job.

Expedite requires proof of hardship lots of it, and even then they might not aprove it and then you spent all that time waiting to find out when you could have gotten a job and made your situation better.

It seems like hardship but if I was them.. only one of you was fired the other left willingly. Not to mention you could easly get a job back in the states it seems too.

I know its hard being a part but it seems like it would be best to knuckle down and go back to get the job so you guys will be able to settle more easly when she arrives.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I'm sorry you're getting depressed. Yes, this whole process can be very taxing. But eventually, the end makes it worth it all.

In my opinion, I do not believe your situation meets USCIS expedite criteria. I agree, walking away from a career and a promotion does not necessarily qualify as severe financial loss to company or individual. If you do decide to file an expedite request, you would need to send proof. Most people here send via mail or fax, IIRC.

In my opinion...Take the job in US...you guys wont be apart for too long since you have done alot already...my wife and I have been apart for over a year now but almost done..now we just have to wait for an interview date.

I know the expedite criteria is high, and indeed you do have to provide proof. If YOU feel you meet it, then Id suggest calling the USCIS and filing a service request for an expedite, upon with they will send you a request for evidence of your need for expedited process.

What I am thinking, since you mailed your original passport to NVC, it is kinda hold now. Address that problem and try to get it from them, if you haven't received it back.

Considering what everyone has said (thank you for the advice) I won't file the expedition request.

My wife has been a strong proponent of me staying with her in Brazil. Not only do we love the country, but being apart is especially hard on her. However, after hearing what people wrote and combining that with her frustration with the NVC, she actually suggested I head back to the U.S. and take a job to ward off any potential, real, financial problems.

We'll see.

Like yourself, i also moved to my spouse's country to be with him. i was there for one year and 7 months. i can say it was totally worth it. it was a personal decision i had to do to make things work for him and I. it got too hard on me being away from him. right after nursing school i decided to move to the Philippines. that was back in april 2008. i've been back here in California for one year one and i'm trying to start over. we like to think these are just obstacles for us to test our marriage/relationship. it's not easy but it has to be done...for the future. i like to think that LOVE IS PATIENT and i know when that day comes when my husband and I are together HERE, it will aaallllll be worth it. :D

Thanks for the supporting! We are not sure what to do, we really don't want to be apart, but this process is taking forever! I want to go back to school and start my Master, but not sure if I should wait to that in the US or start here in Brazil!

I just wish we had an answer!!! I don't know why is taking that long, and don't have a clue what it is " Additional review".

We've asked about the passport multiple times, politely, and we've only ever gotten back a form letter saying that they're in the process of reviewing the documentation. I filed a immigration case assistance request with a Senator, partially because of the time it's taking, but mostly because of the passport issue. It's definitely THE most frustrating thing, is that to us it's a serious issue and they really could care less.

It is a good option that you proceed currently. Just try the option that I have outlined as well. You should hear something to that email in a day or two.

Also, provide the address in the email to mail the passport back.

Plus, specify to complete the case since it has taken long time now.
