hi here is our situation.

my child was born abroad w/ a US Citizen Parent. we were not able to report her birth to the US consulate due to hubby having leave again ASAP he's in the military and was just in my country for his R&R. Now me and my daugther are in US and i want to file for her N600 / Passport for her to get a proof of her citizenship. She entered US w/ a tourist visa and we can't go back to my country coz i have filed for my i-130 and i- 485 and are pending. also even if we did go back my husband can't accompany me since he will be deployed next month. PLEASE Help us.

Here is our problem:

a.) does she have to be a Permanent resident before we can file the n600

b.) they are asking for proof of citizenship both on passport and n600. which we don't have since we have not reported her birth abroad. and that's the reason we are filing for n600

c.) will she be illegaly staying here in US since she entered w/ a tourist visa and her i-94 will be expiring by the end of nov. 2010

d.) can i only report of birth abroad in my home country is there anyway i can just do it here??

A friend of mine had a USC child but hadn't gotten around to filing the CRBA when she wanted to visit her fiance and take her son to meet his dad the first time (and get the CRBA paperwork done there). When she went to report it in Australia (after they got back from a visit where he was in the US on a tourist visa) she was told what she'd done (bringing a USC in on a visitor visa) was ILLEGAL.

I don't know if that's the case with you but I wanted to warn you.

How old is the child now? Why didn't you file the paperwork before you arrived in the US?

ALso please change your profile as you stated you are filing i-130 and I-485 but your profile says "naturalisation".. that means you are applying to become a USC, and you're not according to your post.

Contact the (American Citizen Services, Consular Section, U.S. Embassy)

Only the child's biological parent or legal guardian, preferably the U.S. citizen parent, can apply for a CRBA. The application must be made before the child's 18th birthday and the child must make a personal appearance at the U.S. Embassy. We encourage parents to document their child(ren)'s citizenship as soon as possible after the birth(s). Delays in reporting of the birth of your child could cause inconvenience and possibly deprive your child of this valuable document because persons age 18 and over are not eligible for a CRBA.
