dear friends,

I am trying to file application for my parents and brother who is 19 years, i am USC and my brother

if you could please guide me the initial start of application i would be so grateful

as far as i know, i do start with I-130? any other inputs very much appreciated

Start by submitting I-130 for your parents and the whole process for that should take about 6-9months.

Then have your mom file for your brother as soon as she gets her green card cos that will be faster versus you filling for your brother.

some say that i can call him as dependent with my mother is there a way to do that,

or as u adviced that when my mom getting the green card sponsors my brother does she sponsor him for permanent residency or any other visa?

so then i dont sponsor my brother at all??

no, siblings aren't derivatives.

it is one i130 for each parent and one for your brother. your brother

cannot come with your parents.

once they become a residents they can file for your brother.

if you file for him it will take more than 8 years.

since they won't have paid any taxes, they will need a joint sponsor

or co-sponsor for your brother, that's where you come in.

he will be 20 in april next year

i m little confused now so how does this work ?

should i sponsor for my mom and brother both with i-130 and then when my mom gets permanent residency she sponsors him or i do not sponsor him mom automatically does when she gets p.r.?

so at this point then i donot sponsor my brother and just sponsor my mother (because it will take him longer)

another question please:

do i also fill up the form g-325 with i-130

Don't be confused...

No don't sponsor your mom and brother at the same time... waste of time (8.5 years currently)

Instead -

Sponsor your mom which the proces will take 7-9 months BY that time your Brother WILL be 20... your mom can sponsor your brother and his process will take the same time - based on the current pocessing times for the F2A category... My recommendation for you is to submit your mom's application ASAP before year end if your finances permits. If this is done your mom could have her permanent status by sept/oct 2011 where your brother WILL still be 20.

The goal is to get your mom here ASAP and to submit your brother's application and get an approval before he TURNS 21 as his will change the category. When the case is forwarded to the NVC at that time he should BE 21 and the you'd have to contact them to ensure that the CSPA will apply to preserve his status as a "child." IF the request is denied then at the NVC stage he will be placed in the F2B category which then and based on the Current Visa Board he would have to wait 5 years.

do i also fill up the form g-325 with i-130? You can fill/submit the form it won't hurt the file .. i submitted it when i sponsored my mom/dad 8 months ago. the I-130 instructions states it's for the spousal packets BUT i spoke to several people at USCIS and who told me to submit the form and i think it helped..!
