Mother a LPR will apply for unmarried daughter over 21. Daughter is in the US and I was told the only way to do it is via consular process, true? and that after that a hardship has to be approved, again, true?

Would someone share the experience?! Thank You.

it's true, children of LPR cannot adjust in country, they will go

through consular processing. if she leaves and has been living

here over a year, she will trigger the 10 year ban. she will be

denied a GC but probably she will give the chance to file a waiver

and you file the hardship letter.

Thanks for the reply everyone. Will the 10 year ban start at the time she overstayed or the time she leaves the US? Because seem like by the time the process is ready, it will be well over 10 years since the first overstay, in that case she would be forgiven, right?! Thanks.

The ban starts when the person LeaveS the U.S.
