Strange NOA after Biometrics asking for biometrics appointment

So it seems like, not surprisingly, even how they update the case status for those with the biometrics requests is inconsistent.

Our case status, the basic "Check My Case Status", says on November 23 they mailed us a request for additional evidence or information. We received two of these spam letters from that date (plus one from Nov 19) but no actual RFE.

If I log into "Sign-In to My Account" (from the link on the case status page), it just says last updated ("touched") 11/24. So even the e-mail from the San Francisco Infopass appointment hasn't triggered anyone to look at our case.

I will mail the copies of all our spam mail and the completed biometrics appointment to the CSC today. That's all I can think of to do beyond wait.

Anyone know what the timeframe for replying to an RFE is? Of course if we get one it will probably arrive while we are gone for a month. I will have my mail checked by a friend, but still...

June 5 - Interview in Sofia - VISA GRANTED!!!

June 16 - POE @ SFO. No problems. He's a citizen now!

Oct 4 - US Passport received. (SS card received some time in the summer; had to go to SSA office to obtain)

hummm, so the plot thickens... am i correct in assuming you guys actually have a changed online status?

mine never changed... my online status is: "11/08/2010, PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED", 3 days after my biometrics appointment. whereas the dreaded RFE letter is dated 18/08/2010 (a week later) but never showed up on the USCIS case status page.

so what is your online status? (and how do you see it was touched?)

If you sign up for case updates and add your case to your portfolio the column 'last updated' will tell you the last date USCIS worked on your case. These are the so-called touches people are talking about. This date is sometimes different from the date you see when you search your application number directly (in your case the date of 11/08/2010).

By the way, the wording on my status is exactly the same "PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED". If I go into my portfolio and click on the case number I see this:

"On November 26, 2010, we mailed a notice requesting additional evidence or information in this case CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

hey there to everyone of you guys going thru all this problems. so i decide to give uscis a call about this issue and they told me to disrigard the noa that it was sent in error.i also went to my local office were i got my bios taken they took a look at the notice and they didnt even know what was going on but they also told me to disrigard the letter. no new updates on the online case status since oct/7/2010 so just waiting on a new answer. also i mailed in copys of asc letter and noa letters. thats all from me GOD BLESS

also on the "portfolio list the last update was on 11/08/2010 (whereas the NOA was sent on 11/18/2010)

they sure are making a huge mess out of this, really how hard can it be to check who all received this faulty letter and send them an apology letter? or even just tell them to disregard the letter?

Yeah, it's almost as terrible as a Dutch 'gemeentehuis' with the exception you can call them after 2PM :)

Thank you for sharing your cases!! Now I'm relieved to know that I wasn't the only one having receiving "non-sense" letters...

So, we should just discard them and wait for the next answer/approval?

I'm worried because my online status remains the same... I should go ahead and call them too, I will write here some updates later!!

My online status still says that they were sending a notice for additional evidence, though. I asked the agent on the phone if she could send me an official note that I could ignore those mysterious letters and status online, but she said no.

When I will contact them in January if online status has not been fixed then, they could say because I didn't respond to RFE, that's why your case is suspended. They could say that. WE really need to have something official to prove to them, because they don't do a good job on tracking each applicant's case. Back on a track of waiting for a good response...

Yes, mine does. It is anoying as I expected them to show some response to the copies I sent them. Nothing, not even a touch on my case status since I sent those. You're right, I think we need to keep an eye on this as there might be an underlying suspense to our case afterall. I'm not confident that there isn't. I'll give it few weeks and will call them in January if nothing changes.

yeah at least i have that e-mail, although i wonder if they'd accept that as proof if the "$%&* hits the fan"

i would advice you guys also mail them though, again the e-mail address (for the California service center) is:

csc-ncsc-followup@dhs.gov

their small print:

In order to assist you in a timely manner, please include the following information with your inquiry (Send a follow-up email including this information if it was not included in your first request to this e-mailbox):

  • The service request management tool (SRMT) inquiry number that you were given when you called the NCSC, If you have called the NCSC and they informed you they are unable to complete a SRMT please provide a brief explanation.
  • The date that you contacted the NCSC,
  • Your name and receipt number and/or A-number, and
  • If available, the name of the NCSC Customer Service Representative you spoke with.

The California Service Center will review your e-mail and respond through this e-mail account or through the US Postal Service.

If you feel the decision on your case was made in error, to protect your rights you must follow the regulations and file any necessary motion or appeal within the allotted timeframe.

What I received today from USCIS is showing they don't have there stuff together:

I sent them copies of stamped ASC bio-notice and copies of the two errorneous letters they send me with following cover letter:

"Dear USCIS examiner:

On the 19th and 26th of November 2010 USCIS send me I-1797C, Notices of Action with the same information. Both letters requested me to make an appointment with my local Application Support Center to have my biometrics taken. As I have been for biometrics earlier on 11/8/2010 I presume these letters were sent in error. Hereby I send you copies of these letters and the ASC Appointment notice stamped at the local ASC in Tucson, AZ.

The online case status report on uscis.gov indicates my case is in suspense as of November 26th. If any additional information is required to resume my case please let me know."

Guess what I got back today:

"Dear Sir or madam:

Thank you for your recent inquiry to the California Service Center (CSC) via fax or letter for information regarding your case status. USCIS has launched a new referral tracking system through our National Customer Service Center. To ensure that customer inquires are handled as effectively and quickly as possible, we ask you to call our National Customer Service Center, which is available Monday through Friday, 8:00 AM - 5:00 PM PST at 1-800-375-5283. The National Customer Service Center will track your with us to resolution.

Most importantly, USCIS provides a case-status online inquiry service on our website at www.uscis.gov just click on the "Case status & Processing Dates" link. Finally, the USCIS website also includes a chart that reports current processing dates for particulair applications and petitions in relation to the date the application or petition was filed. The USCIS processes case in the order received.

Included with this letter was everything I sent them, even the envelope. Just got everything sent back to me and a generic letter. Not happy. Fortunately with this information I was able to put in a service request. They'll get back to me in 30 days. Hopefully with an approval letter. :no:

Well, I called them and this lady told me she would open a service request as my status is still "in suspense" and no RFE letter has been sent out. It basically means that someone is gonna review the case, "fix" the problem and get back to me in 30 days. In my case the result would be an update of my case status or a letter with the information on the RFE. Looking forward to the latter :no:

Since we received two of those strange letters and after my info pass and mailing a copy of the stamped ASC biometric notice didnt do anything to the case status online I decided to call USCIS, talked to an officer. She recognized the issue and told me to ignore the letters, case still in process. I asked her if she can send a letter states that error so we can have some proof she is mailing one, advised to call back withing 30 days if nothing received. case online still says NOV 19 RFE issued.

Aug 08-2011 N-400 package sent

Aug 11-2011 NOA date

Aug 12-2011 check cashed

Sep 14-2011 Biometrics

Oct 03-2011 Interview letter (Fax only)

Oct 27-2011 Interview day >>>>> PASSED

I received a letter from the CSC today, just a regular letter on white paper, not an NOA. It was in response to a "service request" which is what they are calling the note the IO sent from our Infopass appointment Dec 3, asking about the kooky letters and if we actually have an RFE or not. It states:

Our records indicate that we already have your biometrics; therefore, you do not need ot be scheduled for another biometrics appointment at this time. Our records also indicate that no Request of Evidence is being issued at this time. Thank you for your inquiry.

No mention of the kooky letters. No touch on my account. No removal of the message on my status check page, which still states that they sent an RFE.

But anyway, I guess that is good news that the note saying we have an RFE didn't really mean we have one???

Hope that's the same for you others with the potential RFE...
