Hi,

I am ready to file for N400 based on 5 years rule in NYC, I am currently unemployed and soon the benefits I am receiving will also end.

Can I apply for the form i-192 to waive the fees for N400? Should I file this form BEFORE file n400?

Pls advice

Hi,

You can try but there is no guarantee that they will accept it. If you were filing for ROC - which is required- then I can see how it will affect you; but citizenship, it is not required to file (now) and you can wait until you are financially stable. Unless you provide them a good reason why it is in your best interest to naturalize, then they may look at it in this angle.

sorry about your unemployment,....the form 1-192 is for pernission to enter as nonimmigrant, i'm no sure what it is you are saying, the n-400 you can file if you have five years resident,

Just reading the instructions for the I-912, the N-400 is covered and sure looks like my stepdaughter is eligible. So why did I give her $675.00?

Really all you can do is to read the instructions and determine yourself if you think you are eligible, fill out the form, and try. Never hurts to ask, what may hurt, is the answer you get.

Several people here on VJ tried for the fee waiver (no job - no savings and expensive medical issues - and that was for AOS) but they were all refused. Apparently it is almost impossible to get and causes long delays. Otherwise, many of us would qualify for it! :yes:

I would suggest using your savings or delaying till you have more cash. Applying for the fee waiver seems more trouble than it is worth (because of it being so rarely granted).

How could you even think about applying for a fee waiver on the AOS as a sponsoring US citizen having to prove first you have a zillion bucks even before applying? May stand a better chance with the N-400, because you already came here with gold plated streets expecting to earn a decent living when we just had the worse economic collapse since the great depression.

But you are correct, in my entire career, negotiations was always a very important part of my job and was pretty good at it, except when dealing with our government. Just cannot negotiate with our government. They are not here to serve us, but rather to screw us.

i applied my N-400 with I-912, the process is delayed a bit becaue they have to decide to apporve you or not, and when filling out the form make sure to be detailed and provide for them all the necessary documentation such as tax form.

01/26/11(00) --> Sent via USPS to TX Lock box N-400 w/ I-912(fee waiver)

02/01/11(07) --> Received by USCIS confirmed by UPS

02/22/11(28) --> Received I-797(NOA) from USCIS for I-912 being approved

03/02/11(36) --> Received I-797(NOA) for biometrics notification

03/22/11(56) --> Went to ASC Alexanderia for Biometrics

04/18/11(83) --> Got the Yellow Letter

05/16/11(110) --> *Touched*

05/20/11(114) --> Received I-797(NOA) from USICIS for interview

06/22/11(147) --> Interview

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
