probably putting this in the wrong area once again......

So yesterday morning we sent off all our paperwork...... I-130 concurrent with I-485.

not sure how long the process takes but my question is:

How does my husband file his taxes? he's married and has to check the box, but I have no numbers as of yet and not sure if i will by tax time, he's been supporting me and my daughter for the last 6 months....... anyone have a answer to this question?

you can get a tax number and file joint tax for the 2010 year, you will get a better refund, and it's good to show evidence of marriage,....this is what you have to do call the irs 1-800-829-1040, ask then to send you a w-7 form,tell your spouse in another country we are married us citizen, you want a itin number, that itin number eill be your tax number until you get your social security card,, but the other has to sign the w-7 form and mail back to the irs, good luck

You may have to make a 6013(g) election. Supposedly this is made to treat a nonresident alien as a resident of the United States for tax purposes.

Not sure about this. I may be in the same situation and came across this doing some research.

Great post This is what I had to do file form w-7 with tax return with marriage certificate authenticated copy of passport and birth certificate of my foreign spouse. Took 6 weeks to process the tax return due to paper filing and itin processing.

If you are marital status is married on the last day of the Calendar year, you are eligible to file "Married Filing Jointly".

Currently, IRS does not issue ITIN separately. You have to apply it by completing W-7 form with the supporting documents along with other tax filing papers.

It is paper based processing since W-7 is involved, the address to mail entire package is Austin, Texas.

Please note that, though MFJ will have the "best refund", you should include the "world wide income" if there are any foreign earned income.
