I-485 based on F4 Miami processing

Hi,

I hope some can help me or has a base with a similar timeline in USCIS Miami local office.

I filed for I-485 on Aug 2, 2010, I have received receipts, done biometrics and received EAD. Yet I have not received the interview letter and has been almost four months. Other peers in my same case, had already received their green cards.

Does anyone know if Miami USCIS local office is running behing or the processing time.

Should I be worried that when I went to USCIS on Nov 3, they've told me my case was not yet at the Local office.

Please help me out!

It can take 5 months or more. Also with the holidays coming expect delays as people are on vacations and they dont work on holidays.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

F4 is a family-based category 4, USC sister/brother, I think it does belong to this section and not to the "work/student/tourist". Thanks.

Do you file an I-130?

**Edit - according to this thread: http://www.visajourney.com/forums/topic/249372-f4-visa-would-my-dad-get-his-green-card-right-away/ you would get a GC on entry, no AOS needed, unless you're already in the country that is... in which case, what visa did you land in the US on?

You are right though. I am moving this thread to it's proper location (as the thread I just posted indicates).

I was protected by the 245i when applied for I-130 prior April 31,2001. Therefore, while in the US I applied for AOS by applying to the I485.

My application was sent on aug 2,2010 and many others with my same timeline have already received their interviews and greencards. And even their processing time at their local uscis offices were about the same as mine.

Im concerned as why may case is behind. Thanks!

To the OP - you are saying you were grandfathered in under 245i (the LIFE act)? On what type of visa did you originally enter the US - as a visitor, as an immigrant or through someone who is employed in the US? How did you enter the US prior to 2000?

Processing times for AOS vary considerably. Applying under the LIFE provision may mean additional checks that need to be done (both security and immigration related) and this may be one of the reasons why your application is still being processed. You could make an Infopass appointment at your local USCIS office and ask to speak directly to an immigration officer for a status update on your case.

don't worry, it could be up to 6 months. not every case is the same

so you are still ok. just a little more patience and you're done.

please explain the whole process? why were the protected? are you sure both of them were? who filed for them? when did they enter the country? from what country are they fromo and why did they send the AOS packet.

Hi Musafir,

In my case, I was protected because my sister file an I-130 petition for relative prior April 30, 2001. On August, my Priority Date, which was April 17, 2001 was current, therefore, I applied for an adjustment of status here in the US. I have yet to receive the interview letter but as per other cases same as mine, USCIS only request evidence that you were physically here before April 30, 2001.

I've never heard of some kind of registration yet I don't know if it is different for the countries you mentioned, which I doubt it.
