So we had our interview 18 months ago and the guy said everything was good. Well since then our case is in "review" status. That is the only answer we get and below is what we have tried:

5 INFOPASS appointments (worthless)

6 formal inquiries from USCIS hotline

1 formal inquiry from Ombudsman

4 inquiries from Congressman

1 inquiry from senator

3 inquiries from lawyer

5 direct letters sent to your local USCIS office's supervisor (all sent certified/return receipt.. and ALL ingored!) not even a courtesy response

Anyone have any other ideas? All we get is its under review.. no RFE nothing just review with no estimate on completion and still no temp Green card

we filed AOS based on marriage and were well within all deadlines.

This does happen occasionally. Somewhere in your file, either related to you or your spouse, there is big bright flashing red light, and USCIS is determined not to issue a decision until it's been resolved.

You've done pretty much everything anyone else would do. They aren't required to make a decision at the prodding of a senator or congressman. They're only required to respond to them within a limited amount of time. On the other hand, they aren't required to respond to you or your attorney at all. For this reason, continued correspondence should be through your legislator's office. At least they'll get some response, even if it's just "in review".

The one thing you could do that you haven't done yet is to sue USCIS. This is a double edged sword. It can compel them to make a decision, and also compel them to reveal the red flag that's causing the hold up. Unfortunately, they often just decide to use their discretion to deny the green card, where given more time they might have approved it. I suggest you keep this card in your pocket, and don't play it unless you are ultimately denied.

So sorry to hear that! How frustrating! You've already done everything that was in your power, but maybe you could keep asking your senator for assistance. Maybe his/her inquiries will help at some point...
