AOS concerns: filed for AOS, can't change name on SSN,

Hello everybody!! :D

Well . . We get married in November 7 , get our married certificate kind of late (november 18) and wew went today morning to change my name for the SSN , she said "nothing i can do you visa is expire" i said " no its not its done in december 2" and then she said the system dont allow her for change my name . . im going to be ok? Im not working also . .

Today we send the envelope for AOS and i saw NOW the change fee for 22 and 23 . . we send it with the old fee today . . should i run to the post office and give a new check? Should i send just the rest of the fee in other personal check? what happen now?? . . im not legal because my visa expires??? . .

:crying: :crying: :crying: im so worried and also my husband specially him . . he get really mad at the office . .

Somebody can tell me i we are fine? . .

Your visa expired the second you used it to cross into the US. Your I-94 is probably good until December 2nd.

You shouldn't run to the post office, there is no guarentee that you'll get the cheque to the right petition. They will send back the petition and ask you to refile with the proper amount

Go back to the SSA office when you get your NOA for your adjustment of status and see what they can do. You can't work anyway until you have your EAD so no use in rushing to get your married name on your SSN - because an SSN alone is not work authorized

I am pretty sure you can not change your name on your SSN number since you are too close to your I-94 expiring. This is not an issue since you have sent in your AOS paperwork. I believe you will have to wait until you get your GC to do the change. Don't worry about the AOS fee changing on Nov 23. You sent it in before the 23rd so you should be ok with the old fee. If not then they will either send it back and request a new check or you will get an RFE for the difference in amount, although I suspect that you won't have to pay the new amount. If someone else has better info please chime in.

yeap, your AOS package is post marked Nov. 22...so you're good to go! :thumbs: Good luck and welcome to the November filers club ;)

As for the name change, since you cannot work anyway til you get your EAD, wait for your GC with your new name on it...

You can change your name at ANY time, even with your I-94 expired, but as others have said, you don't NEED to change it, and you can wait till you get your EAD or GC when you will definitely be able to change it, and because you can't really use it to work till you get your EAD (or GC).

You have a passport that is valid for identification. You have a Social Security card with the same name as the passport name. You have a marriage certificate that proves you changed your name. That should be enough.

What Jim said. Also, you don't need to change your SSN to get yourself added as married name to all that stuff. Mine is STILL in my maiden name and i've been married 12 months now, I just haven't had a chance to get to the SSA.

I've changed my bank account, added to my husbands health insurance, all that stuff in my married name even though my SSN is in my maiden. When I get my DL (drivers licence) I'm pretty sure I'll need to change my SSN before then because I think link it to that record (from what i've been reading). Not a huge deal now I know where the SSA office is.

Change your name after you have your green card. Do not worry about it until then.

Your visa was cancelled when you entered, your I-94 replaced it and now you are married. You are legal. You are fine.

My wife entered the U.S. on a K-1 Visa. Yes, we had some issues at the Social Security office only for the fact that the agents in some cases are unsure as to how to handle the K-1 visa process. However, once the agent submitted proof of our certified marriage license via the system, they changed the name on her card before she even received her first SS card. Thus, if you have been issued a SS card, just bring in your certified marriage license to the SS office and they should be able to process the name change.
