As a post in the CR1/IR1 section, this type of petition requires an I-864... which does not need notarization. Only if this case were a K visa would the other form be used.

I checked again and its says in black and white, 1-134. I have done an Affidavit 1-864 already and submitted it with my other documents to the NVC. However, I am now at the interview stage and they have asked for another affidavit, only this time as previously stated, they want the 1-134.

I hope this clarifies everything. I have no idea why they ask for two affidavits. However, I'm not taking any chances. I will bring a notarized 1-134 and an unnotarized 1-864. That should cover me.

Have it there at the interview if you so wish....but it is definately not needed. Many things are on the instruction letter one receives for the CR-1 that have already been submitted to NVC. These are also not needed if NVC already had them as they are forwarded and within your case file. I also wonder if they have sent you the correct instruction package.

The I-864 is the ONLY affidavit of support used for immigrant visas and adjustment of status cases. The I-134 when requested is ONLY used for K visas

All the best to you

I was sent the optional form 171 with instructions, which looks the same as is used for the K1 visa, which I have also done in the past. This is my second time around doing this after having my K1 invalidated because I married my girlfriend during the process. You are correct about them asking for things that are already included in documentation for the NVC. I however, do not trust the staff in the Bangkok embassy enough to trust that they will have all of my previously sent documentation, I'd rather be safe than sorry. I was sloppy once before and should have checked on the marriage before making such a move. this time I'm more cautious.

Anyway, thanks for your input.

Morindae,

It does not make sense. If it is CR-1/IR-1, then it has to be I-864, if it is K-1/K-3, then it has to be I-134. Can you email the US Embassy in Bangkok and seek their advices? Once you submit the I-864, your spouse won't need to take another I-864 to the interview. Embassy will get the I-864 packet from the NVC.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

The first thing that I did was to email the embassy a few days ago, however, I'm still waiting for a reply. Until then, I'm depending on all you lovely people to help me out with this as well as provide information for others that will tread this path in the future.
