My wife arrived in USA from The Philippines on 10/27/2010 ... from The Embassy in Manila she was issued a CR1 visa stamp on her passport. She waited 5 weeks to come to USA for our 2 year wedding anniversary and was issued an IR1 visa stamp on her passport as we had planned and hoped for. She received her Social Security Card after 9 days with NO restrictions. WE Have Not received Welcome to USA Packet or her Green Card yet. My Question Is : ... since she was issued a CR1 visa from Embassy and received an IR1 visa from immigration at Point Of Entry, DO WE HAVTA File a Adjustment Of Status within Time Limit or are we Finished until she applies for Citizenship ???

People make mistakes with Adjustment of Status (AOS), Affidavit of Support (AOS) and Removal of Condition (ROC). All are the different children of different mothers!

Ok, come to the point.

Since you have I-551 stamp with IR1, most probably you will have IR1 plastic card.

If it comes as CR1, file I-90 with a fee waiver (USCIS error) to replace the card.

This is not applicable to you - If anybody gets CR1, they need to remove the condition (ROC) within 21 and 24 months after POE to get 10 years IR1 green card.

This is not applicable to you - If anybody gets CR1, they need to remove the condition (ROC) within 21 and 24 months after POE to get 10 years IR1 green card.

:thumbs: Correct! Your wife should be receiving a 10-year green card, as she arrived at POE on an IR-1 visa and not a CR1 visa. There is no adjusting of status anymore. Next, would be naturalization in ~3 years.

BTW, my wife is from Baguio, too! :D

hello, you got married in the philippines the embassy gave you a cri visa, at the poe thay stamp your passport 1-551 rigth,so therefor youdon't need adjustment of status, you recevived your social securty card , now your waiting for you welcome to america green card , you be getting it in december or early jan, ok it takes two or three months , your fine

hi the green card is good for two years then you have to remove conditions 2 years minus 90 days so start to get all your evidence collected you have a lot of time good luck,

Yes, if they stamped it as an IR-1 visa, then everything else that follows will be based on that (IE, 10yr GC). It took a little while for mine to arrive. I got here in April, and I got my welcome letter and greencard about 60 days later :)

My husband also arrived on a CR1 after our 2 year anniversary. We informed the CBP officer who looked at our wedding date on our marriage certificate and said he would make note of it in our file, but couldn't guarantee they would send the correct GC. Sure enough, we got the incorrect 2-year GC. By the time we were able to talk to the CBP officer at POE the passport had already been stamped with a CR1 stamp. But it doesn't really matter what stamp you receive (your passport stays with you), it depends what info travels in your immgration file from POE to USCIS, and whether or not USCIS pays attention to the change.

ok, hope this help.

1. you were issued a CR1 visa from the embassy because at that time you weren't marry for 2 years.

2. like you say. you know what's going on. your wife waited for your 2 year anniversary to come to the United States so, they can give you a stamped say (IR1) on it.

3. if the stamped said ir1 on it. there is no adjustments or anything like that because later on they will send you the 10 years green card in the mail.

4. you said that you still haven't received anything yet. ok. its because every cases are different. mostly waited 1 months but sometimes 3 months and some cases 6 months and others never received anything.

7. ok if you are still not sure if you have to do anything in the future. USCIS will send you a letter saying that you need to file or eligible to file the cr1 to ir1.

Hi, all. now my question is? is this for couple who physically lived together for two years or can this also be possible for a couple who lived separately, like for example one spouse who is the US Citizen living in the US and one living abroad who is immigrating here with CR-1 visa?

this is for people who is living in the United States that have a CR1 greencard that need to change to a IR1 greencard. A person who hold a CR1 greencard can file together with his/ her spouse or can file as single petitioner (if they are not together anymore) under certain circumstances. for further details on that you need to consult a specialized immigration lawyer.
