Will Bankruptcy in th UK affect the process?

Hiya,

It's been a while since I posted here, mainly because for the last three and a half years I've been living in the UK with my husband. When the financial meltdown hit last year it affected us pretty hard. He lost his job, and my hours got cut and we very quickly got behind on most of our bills. His parents weren't in a good situation to help us much, other than to be able offer him a place to live while I moved back to the US to try and get us established here.

The plan was for me to move over first, and I've done that and have found a decent job that will pay enough to satisfy the income requirements when we finally file so I can prove I can support him until he finds work here. I don't get paid enough to be able to cover the debts back in the UK though.

My husband is getting threatening letters and even though he's tried to work out some payment arrangements, he still hasn't been able to get back into work yet. He's looking at bankruptcy as one of the only options we've got. He doesn't want to do that if it will affect his filing status. We've been in different countries since I moved over in June, and we really wanted to file starting in January.

Does anyone know if his declaring bankruptcy in the UK will affect his status coming over to the US?

No, definitely not.

They only look at the US citizens current income, to make sure that you can take care of the both of you. His bankrupcy or his debts wont count towards anything and wont effect credit for him in the US or anything like that.

Nope, no interview date yet, Im preparing my waiver, so its giving me some time to prepare the paperwork. I have half a rainforest in folders!

My naturalization - that was back in 2007, a normal track If there was a hen under my custody, I would have tried a fast track It was a kinda bachelor life at that time!
