I am applying for my AOS and was wondering if I should fill out form i-131.

I know its optional but what is the advantage of filling it out now as opposed to later, when I need it.

It is basically advanced parole if there is an emergency that I can re-enter the states, right?

So you guys fill that out with your i-485 or only when you need it?

Also, if we do it now, it costs the same as filling it out later?

The advantage to doing it now is that it would be ready when you needed it, just in case. It does take a few months to process, remember. Good luck.

It costs nothing if it's filed concurrently with (or in connection with) an I-485.

The reason for filing it now is that it takes a couple of months to be approved. The idea is that want to have the AP document in your hand in case an emergency comes up that requires you to leave the US. If you wait until you have an actual emergency then the only way you could get it more quickly is to make an infopass appointment at your local USCIS field office, and it could still take weeks to get an appointment.

On the other hand, if you have more than 180 days of accumulated overstay then there's no point in filing it. You couldn't use it to reenter the US even if you did have an emergency.

Most people include the I-131 with their I-485 as a "just in case", mainly because it's easy, it doesn't cost anything, and they are routinely approved.

The fee is waived as stated so it certainly doesn't hurt to include it.

See the AOS thread in my signature for a list of required docs.

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to " Working & Traveling During US Immigration" as this is relating to AP **
