i just came back from jamaica i went for a petition interview and when the consulator about a married that happened 20 year i forget to put on my application that i file because the person is the one who divorced me so i file for him yes but he divorced because anything went through so the jamacia consular said they are send my application packet back to the uscis do anyone every have that experience and what the out come because that hold the processing of him getting his visa

So, you went to Jamaica to accompany your fiance to his visa interview. The consular officer asked about a previous marriage that happened 20 years ago that you neglected to put on you 1-129F. You told the consular officer that you "forgot" to mention it on you I-129F because he divorced you, even thought the I-129F, section #9 asks for Names of Prior Spouses & Date(s) Marriage(s) Ended. You actually signed the I-129F, certifying under penalty of perjury under the laws of the United States of America, that it was true and correct, prior to sending it to USCIS.

Is that what happened? If so, then it sounds like you were denied because they believe you may have "knowingly and willfully falsified or concealed a material fact in the submission of your petition", e.g., your previous marriage.

I'd venture to guess that you'll have to resubmit your I-129F to USCIS and this time actually tell them about your previous marriage and include a copy of the divorce decree in your package. You may want to consult with an immigration attorney at this point to insure that this is all that will be needed.

If I've misunderstood your post, please forgive me and explain further.

So you brought someone else to the USA with a fiance or spousal visa 20 years ago and forgot about it? Sorry but that is a very unlikely story to a CO.

I think you should get a good lawyer because as mentioned above, this could be considered material missrepresentation and be trouble not just for your current fiance getting a visa but for you too.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

i married him in jamaica and i file for him and he turn around and divorced me i didn't go to any court house and he didn't aslo because his wife that he marry do the paper in san cristbal dominican repulic and he was still in jamaica she marry him after that and file for him and he now in the usa i never receiver a divorced from him just court paper to go to court.

i get married after that divoced and file for someone and we were togateher for a couple of year

so it was just a mistake

So, you married him before paperwork was completed he divorced you and married someone else. Think I got that from the first portion of your statement. But then, am I clear to understand you married someone else? Now you are married to someone else and filing for them?
