HEy everyone

This is G (beneficiary) ... as many of you know I made it to the USA WOOOHOO .. and its been amazing visiting places and getting to know what will be my home with my amazing wife-to-be! this last week my fiance and I started looking into paperwork and everything, I already applied for my SSN and it went smooth without too much questioning or anything! I am supposed to get it in 2 weeks!.. now there is something that is till worrying me ... So at my POE the official made a mistake.. and instead of giving me 90 days to get married he gave us 60 days!... My port of entry was November 1st and he wrote on my I-94 January 1st 2011 so that would be 2 months from my POE... SO we called USCIS and asked about this and they said there was not problem at all.. we just needed to get married within 90 days of my POE and that was it!.. We were really happy to hear that because we plan on getting married around the 7 th of january!.. but it is still worrying me because on my I-94 it still says January 1st and I have nothing to prove that someone at the USCIS told me that it was okay! so in case something went wrong and I did need to get married before january 1st.. there is no way to defend myself!.. so is there anything you guys suggest me to do? any advice??? or you really think I should just dont give it much attention and believe what the USCIS person on the phone told us? please any input would be appreciated.. thank

Congratulations on making it to USA and with your future wedding!

I had a similar situation with my step-daughter. She came over here for vacation. While filling up the I-94 card on the flight, she made an error with the dates. We didn't notice this until about 1 week later. In our case, we called the airport, which was her POE. They then referred us to contact U.S. Customs and Border Protection. We explained the situation, and the Customs Officer told us to come in and they would make the necessary amendment.

I would get it corrected by the proper authority, IMHO. Quoting someone from USCIS may not be enough. I would hate to see you have problems in the future.

congratulations to you guys.. :) you should be fine, it was just a mistake from the officer. it is indeed 90days, PLUS, you already called the USCIS. and oh, if you do look it up in the website of USCIS, its stated in there that its 90days FROM the day of admission.. so, just be happy and focus on your upcoming wedding.. :) best wishes.. :)

well I guess ill call and see.. what sucks is that my POE was miami and I am in Atlanta GA.. so it would be hard to go to miami right now! but ill call and see what they tell me .. thanks

Go to the airport in atlanta and see if they can correct it for you?

When you AOS you will have to send a copy front and back of the I-94 and that would be dificult to explain the date on that to the date that you got married.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

Yeah, I can see that would be a problem. Try and contact Atlanta, as Indy mentioned. Hopefully, they can and will correct it.

If you marry by Dec 31, you could file 2010 income tax jointly with your wife and her taxes would be lower, probably meaning a bigger refund for her.

You can call CBP and ask if they could correct your I-94.

And in general I don't think it will be a problem with your AOS. The terms of your visa say 90 days and USCIS will be looking to see if the marriage occured within 90 days. That's an opinion.

Thanks everyone! I guess I'll call the CBP in Atlanta and see if they can fix this problem because I really cant come to miami and I WOULDNT like to have to send my passport to miami and have the risk to lose it in the mail or something! lol.. so yeah THanks everyone.. !!! this thread is still open to any other input tho.. LOVE YOU guys thanks for always being there for us!... really appreciate it

Definitely call CBP at the Atlanta airport. You are looking specifically for the "Deferred Inspection Office." They should be able to amend your I-94 to have the correct date. They normally charge $300+ to replace a lost or mutilated I-94, but they shouldn't charge you anything since their officers made the mistake. Hold your ground on that!

When I PoE'd by car in North Dakota in July '09, the first I-94 they printed out for me was marked for multiple use. The officer caught it right away though, and called over the older guy to show him how to make a single entry one. :) I don't know what would have happened if I'd been naive/ignorant enough to try to leave the US and use the multiple entry I-94 if they hadn't caught it. Probably wouldn't have been good. :)

The AOS adjudicators may very well be looking to ensure that you married prior to your I-94 expiry, rather than within 90 days. Seeing a short-dated I-94 that expires prior to your wedding date might confuse them. It is very important not to do anything that might confuse your AOS adjudicator! Government employees have a marked tendency to do random, inconvenient things when they become confused. Definitely best to get it fixed promptly.
