Please let me know if this is the wrong forum - and feel free to move it. Here's my story (I still need to fill out my timeline). I am applying for AOS from TN Status, through marriage to a USC. I have a few questions about the I-130 form. (that's the only one I've really looked at so far so I am sure I will be back with even more questions) Thanks in advance to anyone who can help!

1)For "Date Arrived" in question 14 - is this the date that I last entered the US or is it the date that my TN Status was granted?

2)In Question 15 - is that the employer of ME or of my spouse (THe USC?)

3)In question 19 - under "your relative's address abroad" - I've been living in the US for a few years - should my "address abroad" just be my parents address in Canada? Can I leave it as "none?"

4)Question 21 - if we live together now, do we put this address there? Or our last address before where we currently live? (Since the addreses are listed on page 1)

Thanks so much!!!! Sorry if any of these seem obvious - I just don't want to mess anything up.

Hi and welcome to VJ :)

I'm not too familiar with TN process, but for what I know it is an non-immigrant status and so I think you are in the right section since you are filing for AOS using I-485, right?

You ask questions about the I-130, this form has to be filled out by your spouse, not you, since they are citizen and it is their petition for you stay in the US

Eventhough you can and should send it in with the whole AOS package, it is a separate administration by USCIS.

Let's see....

1)For "Date Arrived" in question 14 - is this the date that I last entered the US or is it the date that my TN Status was granted?

Answer: you put in the date the last time you arrived physically in the US, at airport or border crossing (since you are from

Canada you don't have an I-94, right? I saw in the forum people put in 0's or n/a but you still should have a stamp in your passport to show a date)

2)In Question 15 - is that the employer of ME or of my spouse (THe USC?)

Answer: Again, its your spouse's petition - so its their job getting listed.

3)In question 19 - under "your relative's address abroad" - I've been living in the US for a few years - should my "address abroad" just be my parents address in Canada? Can I leave it as "none?"

You can put your parent's address in there if you lived there before moving to the US - my attorney who proofread my paperwork said that they don't really verify this info, it's not a "deal breaker" especially living here for several years. Don't leave it blank or none-it.

4)Question 21 - if we live together now, do we put this address there? Or our last address before where we currently live? (Since the addreses are listed on page 1)

Answer: yes, that's your current address, if you decide to move during the process it definitely will be the last address you two had together ;)

Thanks so much!!!! Sorry if any of these seem obvious - I just don't want to mess anything up.

- Not to worry, it's perfectly normal to ask questions with all those forms and answers, checkboxes etc - and rather ask then having your petition, application denied for missing or incorrect info, right!?

There's no silly questions, just silly answers :)

Good luck on your journey!

M.

Thanks for your response!!! A few more...

I do have an I-94 - you get one with a TN. So do I put the date I got that? Or the date of my last re-entry?

I did not live with my parents before I moved here, I was renting a house....but theirs is the only address I would consider "mine" in Canada. Should I still put that there?

Thanks again!

We put "none - in US" for the relative's address abroad question. I suspect either are fine answers - so do what feels right. Remember, this form is used for people whose spouse's are abroad as well as people in your situation.

I thought you got a new I-94 at every entry into the US, but maybe it's different with work visas, so I don't know. Good luck!

AOS for my husband

oh..didn't expect that you have an I-94...either way, put down the date of your last re-entry to the US - and on another thought, in some forms they ask for point of entry it's enough to list a city and state there (I originally had San Francisco International Airport but was told that San Francisco, CA is enough)
