If I decide not to have my wife get a new passport with my lastname will it be a problem that all of the forms we have filled out during the cr1 process be considered invalid or wrong because we have filled everything out like first name, maiden name then my last name. would this cause problems? Or does it not matter?, at this point I will still try to get her the new passport but it looks like she might receive her visa before she would get a new passport. (I was told the passport renewal process is really slow now and we were married out of the country) .... and her coming to me asap is the most important thing right now anyways.

Is her passport expiring? Or is your concern amending her valid passport? IMO, if you filed all the USCIS forms in one name (First, Maiden, Last), the name on the passport should be the same. But that's just me.

To answer your question: No, it will not necessarily be a problem. If she does travel and the name on visa and passport do not match, she can show her marriage certificate. This show her maiden name as well as her husband's last name (now her last name). The passport renewal is somewhat slow (~6 weeks), but if she renews in the Philippines, I'm sure there are ways to expedite it.

hello..good day!!..I really don't know that much...but I guess it would cause a lil problem(hope not much..)..it's better you get her a new passport with her new name..coz they might check that one during her interview..if ever you were able to notify and report your marriage in the Philippines, all you need to show is your marriage certificate(NSO copy) to prove of your marriage..it is much easier to get a new passport than to tackle all the hassles and problems..btw, she will also have her CFO guidance counseling and get her CFO sticker(emigrant ID) before she will leave the country..they will check of course her passport and knowing she is a CR1 visa holder, they might question her and she would also be checked by an immigration officer at her POE...if I gave any wrong info, kindly excuse my mistake..as far as I understand, it would be best for her to have a new passport with her married name,,sooner, whenever she would go back to Phil from US..she doesn't need a new passport(..as for me, I came through a K-1 visa..so my passport is still with my maiden name when I arrived here, after adjusting status,whenever I would decide to go back to Phil, I need to apply @ the nearest Phil embassy here to get a new passport with my married name)...they said, Life is simple,it's us who make it a lil complicated..God bless us all!!.. :thumbs: :thumbs:

The name on her visa will match the name on her passport (not the forms, they'll change the forms).. there hav been several posts about this.

Her GC (when she enters) will match the name on the visa. So it's up to you. If you think her GC she be in her married name, change her passport.

FWIW, Mhay got her passport renewed in about 2 weeks without an expedite. (14 working days to be exact) You can get an expedite though. The catch to all this is she will have to go to the DFA in Manila (at least that is what Mhay did). It is much easier and cheaper to renew when still in the philippines than being in the US. I had Mhay renew hers right after we had the NOA2.

I believe there is a way to make an appointment for the DFA to renew the passport. Just check out the site online.

On edit, you said that she is not in the PI or you guys werent married in the PI? I havent followed your case. Anyway have her register the marriage and renew her passport. It will save a lot of hassle in the future.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.
