Hello everyone,

My U.S. Fiancé is Navy retired, and he got retirement for disability. So, since then, he hasnt been paying tax returns. He receives his retirement tho SS and VA (Veterans administration). So, he´s about to fill the I-134 form, and like part of the attached documents, to proof enough income, he wants send these documents from the retirements, beyond the amount informations of his bank account. Would it be enough?

11/05/2010 - I-129F Sent

11/08/2010 - NOA1

11/11/2010 - Touched

02/19/2011 - Medical exam

03/15/2011 - Touched

04/19/2011 - RFE (email/textmsg)

04/22/2011 - RFE hardcopy

04/25/2011 - RFE reply sent

05/03/2011 - Touched (RFE response under review)

05/16/2011 - NOA2 (Finally, after 6 months - exactly 189 days)

05/25/2011 - NVC received our case

05/31/2011 - Got our new case number (NVC sent a letter)

06/01/2011 - The U.S. Embassy in Rio de Janeiro received our case

06/07/2011 - Received our interview date

08/09/2011 - INTERVIEW!!! (Approved)

08/13/2011 - Received my passport

09/22/2011 - GOT MARRIED!!!!!!!!!

Does he meet the requirements of the poverty guidelines?

for a house 2 people its $18,212.

Im not sure if he qualifies for the military 100% because hes retired, you may need to call the military hotline and ask them.

He may also need to provide proof as to why he doesnt have to file taxes.

Hey Inky,

Why porvety guideline? He makes over 50k a year.

And he got 100% disability through VA. He has MS - Multiple Sclerosis.

And since he got 100% disability, he doesnt need pay taxes.

But, i´m in doubt, if these documents are enough.

The I-864 and the I-134 both have poverty guidelines that have to be met.

On the guide it actually does say active duty military so i dont think he qualifys for the 100% and he will need to make the 125% mark but he seems to make the mark!

I realize he doesnt need to file them but the embassy may need to see a reason as to why he doesnt file because you are to include a copy of your taxs for the last 3 years including W2s.

Well, i sent a e-mail to the consulate here asking about it. Waiting for their responses.

The I-864 and the I-134 both have poverty guidelines that have to be met.

hi everyone! when should this be affidavit of support be filed? my fiance didn't include this in our I-129f application because it the instructions in filling up that form didn't require that it should be submitted together with it. But we have yet to receive any notice from the USCIS too that we need to submit it/and or any additional documents they need so i presume my fiance did it correctly. I think the said affidavit will be material on the interview at the US Consulate int he host country, although not really sure about this. Please share your views and experience. I would be glad to hear it. Thanks much!

Your fiancé is correct. The I-129f is just the petition to file a visa, you don't need the I-134 Affidavit of Support until the actual visa interview at the foreign US consulate.

btw, how long did it take you guys before you got the NOA2? just curious, been waiting for 4 mos and 5 days now, and our case is still in the "Initial Review" sometimes i wonder if it will ever change, haha..,it's been like forever. Thanks again! :)

Thank you so much for that Kristy! I felt a bit of relief, too bad for me, they have only approved until July 14, 2010 (NOA1) mine is July 17,2010..3 days after. haha. Btw, when did u have your NOA1?
