How much proofs should be sumbitted at the beginning?

Hi, I'm new here I wanna ask 2 questions.

My fiance is in China now. After we know each other for about 1

yr online he came to China on Feb this yr. Since the first time he

came to visit me he don't want to leave me. Now we know each

other about 22 mo. We are both cautious persons and for some reasons

we can't marry in China so we decided to get marry. So we want to

apply K1. He is from Minnesota.

1. Could we directly send the application to Nebraska service center

from China or we have to send it to his sister in Minnesota who he

live with before coming to China. Then his sister send it. But acutually

we hope go to Seattle where I have a cousin there. Could we go to

Seattle to apply for my temp green card?

2. When we send the application should we send as many proofs as

we can? But I heard if the package is too heavy then when P3 send from

US to US embassy in Guangzhou will take a long time for customs

clearance. Nebraska service center, USCIS and NVC will base on

those proofs to audit the relationship? After they audit then they will

also send those proofs to US embassy in Guangzhou then embassy

audit again? If so then I think the more proofs the better.

Hello!

1.

You can mail it from China or have his sister mail it, I don't think it matters. Whatever is best. I would mail it directly from China to save money.

You do not file 129f petition with regional offices anymore, there is one location to file at, use the above address for EMS delivery.

As far as living in Seattle, just make sure you notify USCIS of the new address every time you move.

Your fiance will need to provide an address on the 129f where you intend to live. Later you will complete DS156 application for visa and again put the address you intend to live. Once you have visa and in the US, you will file an application for green card in which you will again provide your address and will file this application with the Chicago office.

Best advise - be sure to follow all instructins carefully and the guides here on VJ, great tool.

Include several photos of you together at different times and places. Include anything that can link the two of you together and provide proof of a relationship. Some emails and chat logs from when you two met online, phone call logs etc. His plane boarding pass and itinerary to prove when he came to see you. No need to go overboard, just include enough evidence to show you two really have something going on and are serious about committing to marriage.

USCIS in the US just needs proof that you two have met at least once to approve the petition, but i would send more than just that. This is called "front loading" the petition with evidence. So that once it goes to Guangzhou they will have strong evidence already, when your interview date comes you will want to bring more evidence of the ongoing relationship. The real challenge is proving your relationship to the Guangzhou consulate.

How long will he be in China? I think after 6 months you can do DCF= direct consular filing? I read here some people did that got approved in about 2 months.

Otherwise just file the K-1 those take about 6 months.

You will send the application to the lockbox facility in Texas. One of the addresses for it was given in this post:

If you were to send it from China, I would recommend you send it to the Lewisville address.

Furthermore, only the service centers in California and Vermont ajudicate I-129F's. Your application would be routed from TX to one of those two centers.

I think the more proofs the better.

DCF is only an option for a CR-1 spousal visa, it is not an option for a K1 visa.

Dakine, thank you too. You mean the application package sent to USCIS then transferred to US embassy won't include the heavy proofs I sent or it won't take long time for the customs clearance.

Shenzhen, thank you. We can only apply K1 and I guess it won't be as short as 6 month. If it can be finished in 10 mo I will be happy enough. :)

1. If my fiance owe about USD7,000 tax though the past 3 yrs tax return reached 125% of the federal poverty line, will that still be a problem in ecoomically?

2. Some people said if my fiance keeps on staying in China with me that will be an disadvantage for receiving my P2. They asked me to persuade him go back to US after the application. Is that true? But both of us don't want to leave each other. We hope get the visa then go to US together. The purpose of K1 is to let those separated lovers meet each other but now we already together so will that be a problem?

I'm not qualified to answer this one way or the other. However, your above post makes me curious as to why you can't marry in China. If you were to get married in China and your spouse has been living there for more than 6 months, your spouse could DCF for a CR-1.

They don't take into account his debts, just ensure you meet the income requirements and use any assets as well if needed to get above that poverty guideline. Maybe someone else can shed any other light regarding having a tax debt.

Regarding staying in China during the petition, shouldn't be an issue. This question does come up on the affidavit of support I-864 regarding his country of domicile. This is during the AOS process once you're in the US with visa.

For details on that look up form i864 and read Part 4 Number 15 in the instructions.

Technically he should be residing in the US with you once you file for AOS. If he's not then he needs to explain it per those instructions.
