I attended the interview with my fiancee at American embassy in Cairo at 06-03-2010 about my fiance k1 visa, so i wonder why the Cairo counselor cancel my fiancée visa and even after they print it at my fiancée passport with a stamp says (canceled without prejudice), also after the Consular officer which interviewed us at the window (consular officer: carols Zapata) told us we got approved at the interview, and said we will have the visa in hand within 2 weeks.

And also we got with my fiancée passport a letter has no date on it when its processed, and all gov. Papers should have dates when they processed and its state that: the embassy not convinced about our relationship , and they send our case back to usa to get the final dessicon.

what they need else after all they see at the interview and i visit him 4 times because i cant stay away from him, and every visit not less than one and half month and I know all his family and I love them and they love me a lot ,and we had a real relationship, and we had an engagement ceremony and we answer all the questions right at the interview because we know every thing about each other.

I just need to know what the reason for that after i call the embassy four times and they said its already approved, because i was worried that he cant get his visa before i leave Egypt because i was wanting to take him back to usa with me and have a nice trip together and we waiting for the dhl to send the passport to my fiancee home address, but after our interview with 27 days we got the passport in the mail had the visa in it but over the visa there was a black stamp say (canceled without prejudice) ?!

Also we have many pieces of evidence attached to our file, in other words all my life and my fiance life and even the smallest details in the last three years annex to the demand that i obtain for my fiance visa.

I can be convinced that if the refusal came from the Consular who has done the interview with us, but he didnt say he will cancel my fiancée visa he said he approve it !!!! , so who put that stamp in it?

So I want you please to help me to find out:

1 - what happened or what the reason for them to cancel the visa after they stamp it to my fiancée passport and what the consular note in our case and under which ground the embassy sent our case back .

2 Did that stamp (cancel without prejudice) over my fiancée visa will hurt my chance to get for him a visa or even reapply for a visa for him???

3 -And what kind of prove else they would want to see plus which was attached to our file and our good interview result (according to consular which interviewed me and my fiancée)?

did we still had a chance after our case get sent back to reajucted and he still got his visa ?????

after that i ask for my sentor help and he make an inquirey at our case and we got the same copy of the letter stated that the embassy dont belive in our case and my fiancee dont show a real relationship at the interview which surprise me cuse i was with him and the councler told me congrats your case are approved !!!

Please help me and provide me with above information and tell me what to do.

Any help will be appreciated.

06-28-2009 : ENGAGED

10-29-2009 : I-129F Sent

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

05-25-2010 : my fiancee 4th visit to ( stayed 2 months ) .

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

06-29-2010 : case sent back to usa !!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo

Sorry that your visa was canceled but you can wait and see what will happen when they send back to USCIS

About your question of the Canceled without Prejudice stamp, It does not prevent you from reapplying again or your fiance from getting another visa

I'm sorry to hear about your situation. The "Cancelled without prejudice" stamp is used for many reasons and it means exactly what it says. The cancellation of this visa does not "count" against you per se.

My husband (at the time fiance) also had this happen to him (visa issued and then cancelled without prejudice. In our case it turned out to be the CO forgot to have my husband signed one of the necessary forms to be able to issue the visa at the time of the interview, therefore the issue was technically issued in error as the file was not complete. Stupid mistake on the CO's part and it cost us more time and going through background checks a 2nd time --- sigh .... but in the end it all worked out and we received the visa.

You guys should probably start putting together a rebuttal on the denial.

About your question of the Canceled without Prejudice stamp, It does not prevent you from reapplying again or your fiance from getting another visa

thanks alooooooooooooooooooot , cuse you are the very first 1 had the same suitation like me but bpease help and provie me for every step you going throw since the cancled it , you are the only 1 will know our pain so please help me and tell me exactuly what happend after that ,

but when they send to me my passport with that stamp it had a simple letter for that fact the embassy dont belive in our relation blah blah blah , did this happend for you also even before you find out that was they fault ? or you descover that was they fault at the begning ????

and provide me please with the steps and what you do after your case go to the uscis ?

1 ) when you dind out it was they fault ?

2 ) how much time it stay at uscis ?

3 ) how you get that info that was they fault ?

4 ) did you refile again to get your visa ?

5 ) what about the rebuttal ??? what was that process and how you fix that rebutal ??? and what it was exactuly looks like and how you get over it and mange to get tat visa ???

your help will be apparcited , me and my fiancee daying here realy waiting in your answer

Obviously the officer made a mistake on his judgment to issue the visa in the beginning and when he realized that, he canceled it, so i am thinking you should look into the reasons why your fiance was not eligible for a visa and try to fix that before you reapply for another one.
