Hello Everyone,

Please, help us out. My Fiance and our kids have just come to the state about 1 week, we went to the court house and get our marriage license (which is on the way). the confusion part for me is that ...I don't know what steps we need to do for AOS (such as what kind of form do we need to fill out), currently I am unemployment, and still haven't find a new job yet. What should we do.? Please advice.

Thanks

If you are unemployed right now you will probably need a co-sponsor for the Affidavit of support.

How did your fiance get a visa approved if you are unemployed? What proof of income did you provide for the consulate interview?

Did you have a cosponsor?

I am just recently become unemployment, my fiance visa was approved at the time I am still working and exceed beyond the poverty guidelines. The consulate at vietnam certainly did not make it any easy for us. I had to provide my LAST 5 YEARS

For the AOS you submit an I-485. You will also have to complete I-864 Affidavit of Support. You will have to show income equal to 125% of the poverty level for your household size. How many children?

Optionally you can also apply for employment authorization using the I-765.

If your spouse/children need to travel outside the U.S. before the permanent resident card is received, you can also apply for advance parole by submitting I-131.

You need to either find adequate employment or a cosponsor before submitting your application.
