I-130 and affidavit of support (parents)

HI to all VisaJourney family...I have some questions so i can move on to process my parents petition - they are both in the Philippines and im US citizen. I mailed the applications dec 2009 and got a receipt feb 2010. Wonder if theres time that this application expires and I have to file again? My father had a stroke so that made me stop following up with the application, waiting for him to feel much better. Im also worried that he might not pass the medical if he is in that condition? (half of his body cant move still)

But i paid for affidavit of support and IV fees, Im now just starting to fill up the form and gather documents. Hope i can get some idea or answers to my questions :)

- on I-864 do i put my mother or father as principal immigrant (part2) then do i have to put one of them in Part3 check both #8 and #9 or i have complete separate forms for each of them?

- my income is not sufficient so using my husbands social security and VA benefits, does he need to file a separate I 864 for each of them? what documents should we include for him to do this...is he joint sponsor?

- my stepdaughter is single and no kids, agreed to help out..is she a joint sponsor? what forms she needs to sign and documents she should provide?

- do i gather all the documents needed and mail it from here in the US or they need to mail it from the Phils?

that is all for now but will post again once i come across something im confused...

thanks so much in advance for all your help :)

love,

Rose

What are you going to do about Medical Cover for him?

Is he insurable?

You need to complete two I-864. One for each.

- my income is not sufficient so using my husbands social security and VA benefits, does he need to file a separate I 864 for each of them? what documents should we include for him to do this...is he joint sponsor?

Your husband will need to complete the I-864A

- my stepdaughter is single and no kids, agreed to help out..is she a joint sponsor? what forms she needs to sign and documents she should provide?

If yours and your husband still don't qualify, then your step daugther can also fill up the I-864. .. assuming she's not in the same household. If she is, she will complete the I-864A.

- do i gather all the documents needed and mail it from here in the US or they need to mail it from the Phils?

As for the I-864 and DS-230 forms, yes your family in the Philippines needs to send you the documents so you can send the forms together with the documents to NVC in the US.

R&W,

Thanks so much for the answers :)

Just another thing..do i need to send the original copies (police clearance, birth cert etc.) or xerox copy is sufficient, as i think they will need the original to present when they are called for interview in manila. Can they send the docs to me thru email and will the NVC accepts that kind of copy?

have a good one

You need the originals. You will need to send two sets to the NVC. One originals. One photocopy. Get one photocopy set for yourself too. That will make that three sets.

OH ok I will that..thanks for helping out.

Still wonder if theres a time period I have to submit all the DS 230 and I-864. Is it one year after they got the I-130 application or when its moved to NVC?

As long as you have the Medical Insurance sorted.

Medical insurance is important but not a threshold for denial. Your I-864 is bonding that the embassy trusts that you will provide for your father's medical expenses in the US, and not put him to public charge. Because that's really unfair as you know.

Yes, i know others think he will be a burden and will used up the taxes that we are all paying the govt but he is going to be well provided. Im here in the US 20+ yrs and so its really a big deal to me to spend time with my parents..see what its like to live here, the places they never been before. I have uncle and aunts, cousins in medical profession so I can probably ask them to write a letter just to show that we are in good faith and him coming here is not really a burden :)

All i need is help with the questions that i have so i can proceed with the application. I appreciate all the input and answers.

thanks

I understand that i have to send NVC original documents..are they going to return them all to me or forward them to US embassy in manila? as i also read that my parents need to bring all original and affidavit of support with them (i might have read it wrong) Also they are asking for my original marriage certificate so hoping to get it back.

thanks in advance :)
