excellent information provided on this forum...pretty accurate

need advice....sent in AOS sept 28 alongside AP/EAD..marriage based

still hav a job in trinidad and was recently informed that i had to return back to work ASAP

i called in the 1-800 number to get expedited processing on AP and was told to wait 5 days for further instructions...this didnt sit well with me so i made infopass appt and went in today only for the IO to tell me returning back to work does not constitute an emergency. I had thought the risk of losing my job would qualify under the "severe financial loss to individual" under reasons to be granted expedited AP.

My question to the wise ones out there is this...should i still pursue the option of the called in expedite that i had already started, bearing in mind the documents i can provide if i am askd to fax them in are the same one i showed the IO in my infopass appt or should i just wait patiently to get my AP thru the normal route while my job is in jeopardy?...in a fix here

I think that someone might wonder in the processing of your AOS why you have a permanent job out of the country that you have to return to if you are applying to live in the US?

Expedited AP is hard to get. I have only seen it get approved for severe illness/deaths in the family.

Why exactly do you have a job abroad when you are applying to live permanently in the US? Best quit it. You can't keep working there while you live in the US.

@amykathleen 2005...well i guess it raises questions but i dont hav my GC/EAD yet and really dont see why i cant keep workin until those documents are issued...am i wrong in assuming this?

moreover i am 5 months away from the end of my contract there...hoping i could see it out before moving here permanently

I don't see the point why you want to keep working back in your country while you are waiting for the processing of your greencard to be permanent resident here in US. When I went here in US, I quit my job from my own country and waited for my greencard before I could work.. here in US. We all had our share of waiting to do it legally working in US. It didn't even cross my mind how it's possible to still work back in my home country while waiting for greencard processing or AP processing. Don't know if that's at all possible or legal but i think it may go against you on basis that why are you even applying to be permanent resident within US when you are showing desires to keep your job in your own country.

I can see why you want AP.

I can also see why you are unlikely to get it expedited.

I am assuming you entered on a tourist visa, they will be wondering why you applied to adjust and stay here if you have work commitments elsewhere.

I guess there is no harm trying.

i see ur point and thnks for taking time out to reply.....but i cannot see how it can be illegal to retain my job till d contract expires in march...i intend goin bac to work until i get my ead or GC because i do not see any reason to sit around doin nothing while i can be gainfully employed in a place i can legally work...my wife understands this and we will only be apart for a little while...other couples have made much more sacrifices than this in the name of work or education...i mean, i am a law abiding citizen and if there is a law i am violating, i will resign the job immediately, but if it is not illegal then why stop when i cannot work in d US presently?

i guees ur right...my job is as a post grad researcher with a university and it confers me with a post grad degree when i complete my 4 yr contract.(which is up in march)...

i did enter with a tourist visa and filed AOS...i hav dated ny wife for 3 years and we didnt want to wait further, so we got married..maybe i should have waited and completed my job and then come bac and adjusted my status aftr that or in retrospect, she could have filed for me while i was bac home...

well d deed is done so i hope it all works out..i feel very sad now that most people find it strange i am trying to keep my job at home...strange isnt it

If you can not get EAD in time, you can still leave.

But your will need to go through the CR1 process to come back in.

if it comes down to it, i will rather stay and wait out the process...filed d documents in sept so hopefully it will come out soon...dont want to travel without AP and incur a ban...guess will have to face the music back home whenevr i am eligible to travel..thx much

Wow, this is indeed a rare situation. Don't get me wrong, but it doesn't seem to me like you did your homework about this AOS process! Returning to a job at home until you have a work permit here is definitely NOT what the USCIS would consider "severe financial loss". It is DEFINITELY a bad idea to return home WITHOUT the AP WHILE the AOS is in progress. I would stay put if I were you...as much as it would complicate things with your job. The "not working" part IS frustrating and difficult for someone who is used to getting out every day and being independent, but it's a sacrifice everyone has to make. You can't have one foot here and one foot there at such a crucial stage man! Is pride preventing you from allowing a woman to take care of you for just a few months haha...just kidding. Best of luck. Hope you make the right choice and things work out.

Apr 7 - I GOT THE JOB! So hyped...I feel alive again :)

Returning to a job at home until you have a work permit here is definitely NOT what the USCIS would consider "severe financial loss". lol...thx for ur advice...i guess to uscis it def isnt an emerg...am gona wait out the process...and ur rite, its hard to be "idle" while awaiting d process but its def a sacrifice worth making

We married a year ago, sent the package off for AOS the day after we married; we waited until we had NOA1 to apply for advanced parole. We sent a letter from Lars' employer stating the day he had to return and a copy of his return ticket WITH our AOS package and a letter explaining his situation. After NOA1 was received he called the main USCIS# and applied for expedite. He emailed copies of the letter and ticket to a caseworker at USCIS and he was contacted by our local office. We emailed THEM the same docs and his expedited AP was approved. He ended up having to stay an extra week (YAY) to get it all done, but he was able to get it. Lars had to return to Africa to finish out his work contract. I wrote a lot about it within our March 2009 Filers Group. PM me if you need more info and good luck.

(P.S. we were prepared that he may have to just take a leave from that job if he was denied but everything I read last year indicated that with a little planning, hence the "frontloading" of the AOS package, it was doable)

11/13/09 : APPROVED and visa in hand!!!
