My wifes GC expires Feb 18, 2011. I want to avoid the additional fees so when is the earliest I can file? Can I file today the 18th? or do I have to wait? Do the fees kick in only on the post date for mailing or also when they receive the file? Or is the post date good enough because if so I will wait till Monday the 22nd.

I believe the USCIS will start requiring the new fee on any package they receive on the 23rd... that's when they establish the NOA. If you send the package tomorrow overnight, then they may process it on Monday which is the 22nd. Your window opens on the 20th so if they receive it tomorrow they will deny it and return it.

I will use USPS overnight and knew that I would be close. So they do not only go by the post date? Do you think if they do not get to it on Monday the 22nd they will send it back anyways because obviously it will be the 23rd? It says post date before the 23 or filed but it is a little vague.

I think you are correct - they do say postmarked so I think you will be OK, even if they process it on the 23rd. It is indeed vague...

New Application and Petition Fees Go Into Effect on Nov. 23, 2010

WASHINGTON - U.S. Citizenship and Immigration Services (USCIS) reminds customers that its new fee schedule goes into effect Nov. 23, 2010. Applications or petitions postmarked or otherwise filed on or after this date must include the new fee, or they will be rejected.

USCIS published the new fee schedule in the Federal Register on Sept. 24, following a comprehensive review of public comments received after publication of the proposed rule this summer.

The new fee schedule increases application and petition fees by an average of about 10 percent but does not increase the naturalization application fee.

Q. When will the adjusted fees take effect?

A. The adjusted fees will take effect on November 23, 2010. Applications or petitions postmarked or filed on or after that date will require the new fees.

Q. How do I know whether to pay the adjusted fee or the old fee?

A. Any application or petition postmarked with a date of November 23, 2010, or later will require the adjusted fee, as established in the final fee rule. Applications and petitions postmarked with a date of November 23, 2010, or later, but that do not contain the adjusted fee, will be rejected as improperly filed.

Well thanks that seems to say we should be fine. As stated we expire on 2/18/2011 so our 90day window opens on the 20th, yours would be tommorrow so even better. Thanks again.
