Question regarding attempted expedite with USCIS

Theres no way other than to keep calling and speak to a T2 or wait for your NOA2 really. Our case was approved and due to lack of decent communication with some CSR's and T2's we didnt know we had been approved yet I was still concerned for a few days as Id no idea!

The only advice I can give is to follow up.

Any expedite request will be considered based on the totality of circumstances. Financial is one of them if applicable but seldom will a case be expedited simply because the US Citizen has a financial problem. If the financial problem is connected to the US Citizen's serious medical condition, then it's part of the totality.

The kind of "details" I was thinking of was clarity on who has the problem and the general nature of the problem. An answer like, "I have a serious medical condition and need my foreign spouse to both care for me and support our family." would be details enough. On the other hand, if the answer were something along the lines of, "My foreign husband is sick and lost his job, so WE need him to come here ASAP, so I can take care of him." there would be little chance.

Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

* Severe financial loss to company or individual

* Extreme emergent situation

* Humanitarian situation

* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

* Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

* USCIS error

* Compelling interest of USCIS

if u can give proof what i've highlighted in bold then maybe maybe mayybeeee the expedite will be valid. but then again i might be wrong hehe.

i filed for expedite due to financial hardship. i've turn in my supporting evidence but still no news

I know some of the UK hospitals had nurses from the Phillipines brought in a few years back due to a shortage, so you never know.

If it is employment visa, it would have been helped.

my understanding is that you will make exactly 0% of the shots that you don't take

Id love to know the 'mimimum' criteria required by the USCIS for an expedite. We've seen recently, obviously millitary reasons, serious health issues, pregnancy issues, operations - all on their own merits required this process but thre are also others that we dont get to hear about, for whatever reason.

For instance, I wonder if theres an expedite situtation approved because the petitioner is heavily in debt with banks/govt....

i don't think so infact if it was me i would keep that info to myself , no point in giving the govt. extra info that they don't need/shouldn't have.

...from a govt perspective, not from the public/petitioners perspective.

Some people dont advocate expediting through the NVC as if you're fortunate you can get through quite quickly, but thats if you're lucky. From our expedite request to the packet sent from London has been 2 weeks, so thats very quick in comparison.

My theory is, also why would one expedite at uscis but not request at nvc or consulate. that may open the case up to questions. People may start to wonder why someone did that and not bother with any other stages, plus if requesting the expedite the whole way, you stand a chance of an earlier interview if its approved.

Sorry RichiJenny, I"ve just read this.....what would be the reason for not trying to expedite at the NVC level? I know you said some people don't advocate it becasue if they are fortunate they can get through quickly? Is there any chance at all that trying to expedite could actually slow the process down? Has anyone ever said an expedite could slow the process down? I just want to be very careful and try and do everything in the correct way...thanks for any answers!!

Ive no proof that it does slow it down. I was though in 12 days, Loto through in a little more, but he had virtually all of his processing done. Our case is more like DCF if you will, where I have to take all of the docs to the interview.

Ive had to mail in my forms electronically too.

You will see people saying it can slow it down if denied. If you're approved at uscis expedite, then you have to re-apply all over again for the expedite at nvc level.

Im not of th eopinion it would slow an application down. However it could and most likely would lead to a 'normal' processing time for the petition.

I have read that the criteria for NVC is higher/harder to get an expedite, but again, that may be based on the Consulates decision as its the consulate that decides if a case is worthy of an expedite at NVC level.
