Question regarding attempted expedite with USCIS

So am I right in thinking that if USCIS approves an expedite, once transferred to the NVC we have to request for an expedite there too?

Technically YES, although Ive recently been told once its been expedited at NVC, as its the Consulate that approves it, theres no need to expedite at that level, however Im not 100% convinced and have written to expedite just in case, and will continue to push for the service until Im told I no longer need to.

THis is good information to have.....thanks!!! I wonder how many doctors are approached to write a letter to the USCIS and NVC telling them about medical issues so that you can get your spouse into the country....this worries me a bit.....well...everything worries me until it's taken care of and DONE!!

Also, dr's arent allowed to lie - obviously. Ours didnt mind writing letters at all, just a question of time was the issue. It carries more weight too if youve had a longer term relationship with your physician I believe. Its easier for them to write the note as well.

So I'm assuming the I-864 packet and DS-230 packet eventually have to be sent to the embassy for processing... rather than the NVC..?

It just depends really. If that happens its kind of semi direct consular filing. I believe you take all of the documents to the actual interview with you, and it does cut down some time. But you have to request the expedite as soon as you get your NVC case number, which is easy enough. then you just email the info :

NVCINQUIRY@STATE.GOV

Subject line: 'Attn: PI Supervisor Sue - Case Number - Beneficiary name - DOB'

At the top of the email write 'Urgent Expedite Request & Supporting Documents attached'

List all of the supporting documents you have attached as pdf's.

Include both petitioner and beneficiary details.

Letter of explanation as to why expedite is requested.

Some people dont advocate expediting through the NVC as if you're fortunate you can get through quite quickly, but thats if you're lucky. From our expedite request to the packet sent from London has been 2 weeks, so thats very quick in comparison.

My theory is, also why would one expedite at uscis but not request at nvc or consulate. that may open the case up to questions. People may start to wonder why someone did that and not bother with any other stages, plus if requesting the expedite the whole way, you stand a chance of an earlier interview if its approved.

I actually mailed the IV packet to my wife a couple of weeks ago. As we werent sure if the expedite would be approved. She's since had to send it back as according to the forthcoming DS2001 - they are all needed by me again.

I think the packet coming my way will be a ds230 and ds 2001. It should arrive tomorrow.

Ive finishhed the ds230. I can tick off the ds2001 - which is just a checklist. I will scan them and the expedite documents and send them in via mail and email.

I also emailed the supporting expedite documents to the embassy today as a 'heads up'. When I found out my case had been received and the packet mailed out to me.

Also a word of advice - get your medical in and done once yuove been approved for an expedite at NVC level, or even USCIS approval, as Knightsbridge DR's told me that a medical has to be conducted before an interview is assigned. Its a new / forthcoming rule. As soon as you have your NVC number you can have your medical.

And when you have your list of vaccinations handed back to you at the end of the medical - check they have your correct case number!

No problem at all, good luck. From the very minimum I can gather you have a very strong case. Theres been some expedite approvals recently, myself, CanadianRedneck, I&G, wellingtonboot to name but a few that I know of.

I'm sure my doctor would never lie....I"ve been with him for 20 years now and my son has been with his endocronologist since he was 7 and he's 16 now....we both have good medical history. I never thought it would benefit us but I'm guessing it will.......

no, i meant as they arent allowed to lie - it benefits if you've been with the practice some time so they can write from lengthy personal experience, as opposed to seeing someone walk in off the street.

just wondering what happens about the AOS fee and IV fee, I'm assuming these still need to be paid at some point??

They are paid at the interview I believe. As the case becomes more of a DCF, its all done at the embassy. I read one of the embassy reviews, and a fella had to take in all his docs and forms, handed them over, paid the bills and left with his visa, all at the interview.

I'll be able to personally confirm as soon as my packet arrives from the embassy requestin documents.

I would listen to pshbrk...expedites are based on the reason and circumstances for the request. Many on this site are financially strained due to having a loved one not near them. However, wasting time and energy being upset at an attorney is just that...wasted time and energy. There will be much more time for that at a later date if it's warranted then. Good luck.

FYI, K3 visas are dead, your petition will instead run to NVC as a CR1 visa (or IRL if you've been married >2 years). Suggest you look at the guides to figure out the documentation you'll need at NVC good luck!

i just like to ask, were you able to check how many time does your paper touched since they've got your RFE response?

we have same case, RFE response - they got it November 12. so, if yours was approved after 3 days, i am wondering if ours will get approved today or tomorrow.. thanks. i keep on monitoring..just can't wait. thanks for the reply.
