I-130 sent to U.S. While still with wife in Philippines

I still had some things to take care of here in Philippines. I'm planning to go back by February 2011. is this ok?

Yes, it is okay. It sounds like you are NOT residing in the Philippines, but rather visiting for a few months. Is that right?

It should NOT be a problem. However, if you are residing in the Philippines, you should file the I-130 at the U.S. Embassy in Manila.

I thought about filing it over here but i've been told it would have taken much longer. i just decided to have it send it from my sister's home (my eventual domicile) making the time i'm away from my wife and daughter just a little shorter.

anyways looking at your timeline, it's a quick processing time. did you do anything out of the ordinary in terms of processing or was it just luck of the draw?

well actually i've been living here for the past 2 years. will be going home in February. I thought about filing it over here but i've been told it would have taken much longer. i just decided to have it send it from my sister's home (my eventual domicile) making the time i'm away from my wife and daughter just a little shorter.

Actually, Direct Consular Filing is faster most the time. The petitioner bypasses the National Visa Center process altogether.

Living outside the U.S. may pose problems. Can you prove you were still domiciled in the U.S.? USCIS and NVC may question that.

My wife's AOS was processed pretty quickly. I guess it was luck, because we didn't do anything out of the ordinary. With my stepdaughter's I-130, we actually contacted our congressman and senator to make an inquiry.

well that was the catch-22 right there. i had planned on going home already before filing it but couldn't leave as i was still taking are of my daughter's CRBA over here in PI. we initially planned on staying here for a few more years but decided against it. if that was the case then filing over here would have made more sense...

i read somewhere (can't remember where) that all i had to do was establish domicile in the U.S. for 6 months and that i couldn't be here by the time my wife's interview was granted.

oh well, we'll see
