My husband and I both live in the USA. I am a citizen. Which forms do I need to file so he can get his green card?

You may qualify to simply file to adjust his status. If he arrived her legally for his last US entry and has remained here, he probably qualifies. Click on "Guides" at the top of any page here.

If he entered illegally, another story entirely.

Last time he came to the USA, did he do so legally? Ie on a visa, or the visa waiver program?

Or did he enter illegally, ie sneak in via the Mexican border, or on a fake passport or similar?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Your husband knows if he entered the USA legally or not. Ask him.

eeek ! how they entered doesnt mean #######. when it comes to things like this stick with pushbrk statement "ASK" ... just because they enter on a plane or car and even pass thru security doesnt mean anything so never assume they're legal. they know if they are legal or not, even if their fiancee/spouse does not.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

It is huge. What he means is that if he entered legally, and has become illegal by overstaying their visa, there are paths to becoming legal (namely marrying a USC spouse). If he entered illegally, without inspection, there is hardly anything they can do to become legal.

It is huge. What he means is that if he entered legally, and has become illegal by overstaying their visa, there are paths to becoming legal (namely marrying a USC spouse). If he entered illegally, without inspection, there is hardly anything they can do to become legal.

i understand that.

to clairfy my post... what i was trying to say (but guess i was not clear) was didnt want someone to assume from reading the car/plane post that if they cross by car or arrive by airplane and do not appear to be "sneaking" across a border do NOT assume they are legal; ASK the person.

Hi, which of these two forms do we need, G-325A or G-325 if we file the I-130? Since the two forms have the same information on them.

G-325A

you need to print out the instructions for i-130 and go over them thoroughly
