MY husband petitioned for my daughter. She was denied a visa because my husband sent a 2008 tax return form where he had filed single. The case was returned to Homeland Security for review and they sent us an intent to revoke the petition based on their findings. I have all the paperwork to prove that we are married and we still live together but my husband does not want to send the paperwork because of the IRS. My question is if we do not send the paperwork, will that affect my permanent residency in the sense that my husband and I did not prove our marriage is bonafide? What should I do. I have a deadline by 20 of this month 2010 to send the explanation to the uscis and my husband is not cooperating with me. advice.

This is a very small part of what is obviously a much larger story.

Is your husband a US citizen? Are you an immigrant? What sort of visa did you enter the US with, and when? Do you have a green card? When did you get it? Did your husband petition for your daughter as a step-child? How old is she? Were you and your husband already married on December 31, 2008? If so, why did he file as "single", and why is he worried about the IRS now? Why is he not wanting to help you with this? Most importantly, what is the exact reason that USCIS intends to revoke the approval of the I-130?

We're going to need a much clearer view of the big picture before we can offer any advice.
