Hi guys...I have a similar situation. I lost my job 6 weeks ago. I am receiving unemployment compensation for a year which comes out to $26,988 + court ordered and child support which is garnished and I have pay stubs for $7,800 for a total of $34,788. Will they consider this or do I need a sponsor. I have someone willing but would rather do alone.

What is your household size?

Usually they will not include child support as the income is not ongoing, it's rarely steady, and can stop without warning.

Our household size will be a total of 4. I have court ordered child support that has been steady for 5 years and my son is 8 so we have 10 more years of it. I receive it weekly in the amount of $150 per week and can provide stubs.

What Vanessa is saying is that they can choose to disregard any income if they aren't convinced it will continue for the foreseeable future. I don't know what the statistics are regarding parents who pay vs. those who don't. With the collection methods they have at their disposal these days, I think there are a lot fewer deadbeat dads than there used to be. She is right that it can stop anytime, though. If your ex loses his job then that wage withholding order won't be worth a thing.

I'd be more concerned about them accepting the unemployment. It's definitely more reliable than child support, but it's also for a limited term that is far shorter than the minimum amount of time you'll be bound by the affidavit of support.

If you have a co-sponsor, why not go ahead and have them prepare their affidavit of support and supporting documents. Don't submit them with the petition, though. Just send yours. If you get an RFE, or they ask you to get a co-sponsor at the interview, then you can submit your co-sponsor's affidavit.

I was going to prepare mine and the joint sponsor providing 2 sponsors. I also have a real estate license but dont have pay stubs as I only get paid upon settlement of a sale.

I don't know how it works in your state, but any earnings are usually deducted from unemployment compensation. I don't see much point in trying to show you have both earned income and unemployment compensation.

People who are self-employed or have commission income have a harder time proving their income level. USCIS tends to lean pretty heavily on the most recent tax return, in those cases. If you wanted to show current income then you'd need credible proof that you're receiving money. Bank statements, at least. I don't know what kind of paper records you get with a realtor's commission payment.
