Timeline

So originally we thought the cr1 visa would be the best for us, but now I am reading that our best bet would be to file a k1 application. I live in Canada and want to immigrate to the US to be with my fiance. We have a deposit down for our wedding september 9th, 2011, in Atlanta. If we were to start filing for a k1 ASAP do you think we would receive it in time for our wedding?

that depends on whether you have all the documents needed in a timely manner and you dont get an RFE. . the processing time for k1 is more or less 6- 8 months depending on the individuals case. if you think yours is not complicated, and you have all the documents needed at hand. then i think You will be there before the wedding. congratulations in advance to you too

Agreed Currently it has took 7 months or less from start to finish. You should be fine and have time to spare but start it now. :)

Anywhere east of Manitoba (I think it's Manitoba) processes at Montreal for K-1s, and west of that is Vancouver. If you are out west, and going through Vancouver, you have a great chance of being finished before next September. Montreal is iffy.

My fiance and I sent our I-129F petition away May 24th, and just received our NOA2 on October 20th, so it took nearly the full 5 months. We received Packet 3 from Montreal last week, and are now waiting for an interview date... we anticipate interviewing HOPEFULLY in March, but I'm thinking more like April. So, in total, that's about 10-ish months.

Your case could fly through the service centre. Ours didn't, which is why the entire process is taking longer than I thought it would.

The wait for an interview with Montreal was taking 4 - 6 months a while ago, and they just changed to a new online scheduling system, and I'm praying that it hurries things along.

Oh, hmm, everyone seems to disagree.. haha that's fine, I'm not saying I'm definitely right... I just know that personally right now, the service centres are taking around 5 months to process the petition, then who knows how long for Montreal to schedule the interview.

It COULD definitely be done by September.... but are you willing to bet all your deposits on it?

Well we already have one deposit down, so.. Its either take the chance, or have to wait ages to be together after our wedding next september.

yeah, waiting to be together sucks.

not to be a big rain cloud, but is there any way you could get your deposit back and maybe move it a month later? I know places rarely give deposits back, but it's lots of notice.. you could try.

just trying to be realistic. Upcoming holidays are US Thanksgiving, plus Christmas & New Years... I've heard it said around VJ more than once that once US Thanksgiving hits, it's basically useless to hope you'll hear much of anything from a service centre/embassy/consulate, since they get a lot of time off anyway, and a lot of people take holiday time then, too.

Again, I'm really not trying to be super negative and I hope it doesn't come across that way, I just wanted to present the information to you.

Good luck on filing if you decide to go with the K1! The VJ guides & wikis are awesome. And, when it comes to getting Packet 3 from Montreal, tallfrond from the Canadian forum has an excellent guide to the new P3 from Montreal.

I dont disagree with you but from all the people I have just looked up, new,tben,msr,kulk,sleepy, etc. They all were done within 4-8 months, I think yours is more to do with taking the full service center time line as the rest got noa-2's within 2-3 months. Heck on of them was done the whole process in just 4 months. I think it really depends on different things.

I say talk it over with your fiance and let him know it "could" take longer but you two will be apart either way. The decision is yours but if you choose the k-1 I advise you to start it soon :).

Thanks! I hope so, too! The thing is, I'm committed to teaching until April 30th anyway, so while we would ideally have an interview earlier, to make wedding plans, it won't be the next armegeddon if I don't interview until April. It'll mean we push the wedding til late summer (August), but we'll survive haha... but thanks anyway :)

I'm wondering why you didn't research the timelines before you made definite plans. You know the saying "No money down until visa in hand."

She probably didnt think of how hard it is to get a visa...Me as a Canadian I never thought about the visa till after I was married, we just "did it" per say. I had never even looked into visas and truely that was the last thing on my mind at the time, however i did do everything the correct way :)
