Timeline

Hello, I just received my daughter's 10 year permanent residency card today, and I have received my Two year temporary residency card last year. My question is why is it that my card is temporary resident only when I have filed and been here in the US for 3 years now. My application for adjustment of status was delayed for 1 year and 11 months until I receive my Temporary residency card. I filed for my daughter last year for her adjustment of status, and today I received her card which is good for 10 years. I have been here for almost 4 years already and my temporary residency card will expire next year, can't I apply for the 10 year residency card since I have been here for almost 4 years now and how come my daughter gets a 10 year residency? when I have a 2 year residency?

I believe your daughter's card was approved after your 2nd or 3rd year (can't remember) wedding anniversary... which allows them to immediately issue her a 10 year GC; while yours was approved prior to your 3rd year anniversary. You need to file for ROC within 90 days of your expiration so keep that in mind.

thank you for your reply I guess I am just going to wait another year before I can get my 10 year permanent residency.

Since you received your 2 year conditional GC, that means it is based on a marriage to a USC. Within 90 days of your card expiration date, you have to submit form I-751 which is Removal Of Conditions (ROC) http://www.uscis.gov/i-751

You will have to submit evidence that you are still married, living with the same USC spouse, and documentation that shows your life as a married couple. For example, you should keep all your records with both of you as authorized users, bank statements, insurance, mortgages, loans, leases, bills, utilities, tax returns, to show that you are indeed married for being together and not for immigration purposes.
