Does anyone know if an immigrant has to pay out of state tuition fees? I can't seem to get a straight answer from anyone locally, so I need to be able to argue the point in our financial favor! :devil:

For me in nebraska they said I would have to if i did not have my green card and I was not considered a resident of the state. The requirement to be a resident is to live in the state for 1 year.

You may need to check with your state requirements. As well as the schools requirements.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

What you need to ask the school is how long a person must live "in district" or "in state" (depending on the school) to qualify for the local pricing.

Until they have met that residency requirement then they should expect to pay "Out of state" or "Out of district" resident rates.


Must have info for bringing your Philippine wife/fiancee's child to the US

Yes, unless you have state documentation (usually a valid DL) for more than the residency requirement. You may want to look into talking to the financial aid department to see if there are any grants or other financial aids available. Good Luck.

All varies with the school--so you have to contact them. back in 2005, I was able to get "In-State" rates, as they based it on my Wife (the USA citizens) residency! had to provide a copy of her State tax for proof! varies from School to school!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I checked out ASU requirements (just for curiosity) and in there they list all these requirements for residency, but then at the bottom they say that if the student's SPOUSE meets the requirements, then the student can be considered a resident as well.

Speak to the DSO at the school or the international admissions officer to find out what is classified as 'in state' and what is not

It really depends on the institution. At the university that I work at (and other insitutions in NJ) you must have permanant residency which is one year). It doesn't matter if you have a lincense or not, its providing that you have been in the state for one year. In some instance the registrar may request a voter's registration card, utlilties, state issued ID, etc
