Sending I-130 while still in USA?

HI guys,

im wondering, can I send the I-130 packet while ims till in America, even though we DONT want to file adjustment of status, and I am returning to England.

The problem is, I was meant to leave on Wednesday, but im sick and have changed my flight so im not gonna be leaving till the 22nd, and new fes come in on the 23rd...

okay, and if i do, what do i put on the I-130? when it asks if im still in the US do I say yes, but attach a note saying that i will be leaving? I dont want to confuse everything and make them think i want AOS?

That was a point I did not consider. Perhaps in the interest of avoiding confustion, it is best to wait until you leave before the I-130 is filed.

We filed ours while I was still in the US, no problems what so ever.

You will say Yes to the Are you in the US right now question but there is also a section, I think it's Q22, that asks if you are doing AOS or not. On that question you just put which consulate you will want to be interviewed in.
