Green card after marriage

After me and my future wife marry, how long will it take for her to get her card? She wants to work as soon as she can to help build our future together. One person told me it can take up to a year. Is this true?

Plan for a year but most times it takes less than that. She doesn't have to have a green card to work. You will want to file for EAD with the AOS application and she can work as soon as that comes through. Many times that only takes a month or 2.

It is hard to determine how long it will take to get the green card. I have seen people receive them in 4 months and other people waiting a few years. For the most part, each case is different. If she wants to work before receiving the green card, apply for EAD along with the AOS. People have been receeving their EAD in about 2-3 months. You can begin working once you receiving the EAD.

This site has a nice statistics feature to allow you to see how long it takes on average for people to get their GCs, right now its around 169 days on average from filing I believe. If you look at people's timelines (like mine below) you'll get some idea as well, for example I've got my interview about 3 1/2 months after filing, which means I could have my GC within 4 months of filing assuming I don't have to face a lengthy FBI name check.

Some have got their GCs in 2 months without being interviewed as well.

However you have to keep in mind that for some it can take years, and without being too cynical, if the intended immigrant comes from one of the more "olive skinned" countries in the world, its probably more likely to take longer than shorter.

If your wife wants to work, apply for the EAD and she will get it within hopefully within 90 days of applying, don't count on getting it any faster than that though!

Just some food for thought. The only downfall to applying for an EAD while waiting for a GC is the fact that you don't know when you will get the GC. Because if you happen to get the GC before the EAD then you lose the money for the application. It just happened to my friend. Her Husbands GC was approved before his EAD so they lost the $325. My husband and I are in the same boat as they were. So we are hoping his GC is approved before the EAD, but if not it still works for us! Good luck!
