So here I am, applying for Adjustment of Status with a biometrics appointment tomorrow. All seems to be going well, and I finally took the driver's road test for the driver's license today and passed.

However, the Maine Bureau of Motor Vehicles refuses to give me a Maine driver's license (as a real license instead of the temporary one the examinator gave me) because, since I'm adjusting from K1 status, my I-94 card says that my stay is only valid until the 29th of November. I tried showing her the I-797C Notice of Action on the AOS application, but she wouldn't take that - I need to be able to prove that I can stay in Maine for 120 days before they will give me a driver's license.

Do I really have to wait until I receive my green card until I can get a driver's license? Or is there anything I can show them that I can stay here? Some special assurance issued by the USCIS or something? (And why does this feel like an old Sierra On-Line adventure game?)

Yes, Illinois is like that also.

Or is there anything I can show them that I can stay here?

A Green Card will work.

Some special assurance issued by the USCIS or something?

Yes, the Here is Your Green Card letter.

(And why does this feel like an old Sierra On-Line adventure game?)

It's not. It should be clearly stated in your state driver's license for foreigner's immigrating to the US rules; at least in Illinois is it clearly stated.

Hi Matt,

saw your posting on the front page so I clicked on it so I may be able to give you some advice.

Unfortunately I can't - I'm in California and your post showed me another different handling of something when you are in a different state,

had no idea on the requirements existed you just mentioned.

So all I can do now is wish you GOOD LUCK!! Hope you get the "real" license soon, but am glad though you got to get at least a temporary one

and won't drive around illegally :)

02/03/2011 - Interview scheduled 12:45 p.m. - out of there before 1:30 p.m. - further review

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

02/10/2011 - E-mail notification "Approval letter was sent today"

Late November 2012 (have to look up my receipts ;) - mailed in ROC I-751

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

Unfortunately if they wouldn't accept the NOA then there probably isn't anything you can do. Some states will except it and some states will make you wait until you have your GC. Heck even offices in the same state it can be different. Its kinda like USCIS...always a different answer depending on who you talk to.
