Good day everyone,

There are some questions about EAD work permit I have and would be very appreciated if someone has the knowledge to enlight me on that. Thank you.

1)What is the difference between EAD work permit and H1, for instance, once I got an EAD card does that means I can bypass applying H1 and wait to apply Green card later on?

2)I have a SS card with "for work only with DHS authorization" words on it, am I qualified to apply one?

3)Is EAD really easier to apply than H1, what are the drawbacks?

Timeline

Your J-1, does it have a home residency requirement? Meaning, after the J-1 expires, you may HAVE to return back to your country for a minimum of 2 years

An H1b is dual intent, meaning the goverment assumes after a certain time, the H-1b holder will adjust status, not the case with a J-1

The J-1 is easier to apply for, the H-1b are capped, meaning only a certain number are issued each year.

1. No - you can't bypass proper procedures - the EMPLOYER has to submit a petition to USCIS and USCIS has to approve it BEFORE you can apply for a work visa in your home country's US Embassy.

2. You won't get far with that SS card - in J-1 program, you are only allowed to work 20 hrs on campus or if you're an au pair, 20 hrs babysitting

3. You can't apply for an EAD - you don't have a qualifying reason.
