Are There Exceptions to Who Needs This Form?

Any intending immigrant who has earned or can be credited with 40 qualifying quarters (credits) of work in the United States. In addition to their own work, and by their parent(s) while the immigrants were under 18 years of age. The Social Security Administration intending immigrants may be able to secure credit for work performed by a spouse during marriage (SSA) can provide information on how to count quarters of work earned or credited and how to provide evidence of such. See the SSA website at www.ssa.gov/mystatement/credits for more information;

Ok, so if you have been married for any length of time, does this mean if you have 40 credits between the two of you that you can skip the I864 and simply supply your SS earning statement?

Second question, are the only credits you can "claim" ones during the period in which you were married? For example if a couple has been married say 10 years, can the immigrant claim the spouse credits for only the 10 years or the spouse credits for his/her entire working lifetime?

I don't know if a non-working spouse will get credits based on working spouse's credits from SSA.

When I looked at my social security statements, I have the credits. But my wife and kids will get benefits if I am disabled or dead.

Any other social security details experts?

Ive been reading up on this one. I believe that if you have a family business and your spouse works for that business and, if she or he files a separate business return then they too can get credits of work over and above the 4 allowed. For example, if I make over the designated amount equating to 4 credits I believe the remainder can be shared. I dont know how many or how its caculated for a family busines but its worth looking into. Anybody know any more about this?

In this case, the other spouse is also working and paying taxes to get the credit.
